Heard both sides. Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 34/2026 registered with M.I.D.C. Waluj Police Station, Dist. Aurangabad for the offences punishable U/Sec. 80, 108, 3(5) of the Bhartiya Nyaya Sanhita, 2023.

Informant is the mother of the deceased, who committed suicide due to the harassment caused by the accused persons and persistent demand of amount which she received towards compensation from the Insurance Company. Her earlier husband died in an accident. In September 2024 her daughter received claim amount. It was her second marriage with Gopal

2 936 ba 440.26 Sahane. Applicant is real brother of Gopal.

Applicant is arrested on 14.01.2026. The investigation is underway. It is contended by the applicant that there are no direct allegations and the involvement of the applicant is doubtful. He is ready to cooperate with the investigation. 4.

Learned A. P. P. would submit that the investigating is still going on and custodial interrogation of the applicant is required in order to disclose the financial transactions. It is submitted that the role of the applicant along with other persons is incriminating and no relief can be granted at this stage. 5.

It reveals from record that husband of the deceased is still behind bar. Sister-in-law of the applicant namely Kavita Kailas Chikate has been granted pre-arrest protection. Applicant is in jail since 14.01.2026. First information report does not disclose any incriminating role attributable to the applicant. The allegations are omnibus in nature. No criminal antecedents are pointed out against the applicant. Ends of justice would be sub served by releasing the applicant on bail on certain conditions. 6.

I, therefore, pass following order.

The bail application is allowed.

Applicant - Samadhan Ambadas Sahane shall be released on bail in respect of Cr. No. 34/2026 registered with M.I.D.C. Waluj Police Station, Dist. Aurangabad for the offences punishable U/Sec. 80, 108, 3(5) of the Bhartiya Nyaya Sanhita, 2023 on condition of furnishing P. R. bond of Rs. 40,000/- (Rs. Forty thousands only) with one solvent surety of like amount. C.

The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.

D.

The applicant shall report the investigating officer on every Friday between 12.00 noon to 4.00 p.m. till filing of the charge sheet.

E.

The applicant shall co-operate the investigating officer and furnish information if called by the I. O.

F.

Bail application is disposed of.
