The applicant is seeking regular bail in connection with Crime No. 21/2026 registered with M.I.D.C., Walunj Police Station, Dist. Chhatrapti Sambhajinagar for the offences punishable under Sections 109, 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023, under Section 4/25 of the Arms Act, and under Section 135 of Maharashtra Police Act.

It is reported to the police by the informant that on 08.01.2026, while returning home from the work, the accused met him. He was abused and threatened by accused Mari @ Rushikesh on count of their old quarrel. He was armed with a sword and tried to assault him. He sustained injuries on his back. The applicant is alleged to be one of the accused persons. 1/3

The investigation is underway and charge-sheet is yet to be filed. With the assistance of the learned A.P.P. I could go through the papers of investigation.

It reveals from record that there was old rivalry between the informant and main perpetrator Mari @ Rushikesh, who was assaulted with sword at the relevant time. No motive can be inferred for the applicant to commit offence. The injuries are not on vital part of the body. His implication is because of his association with main perpetrator. The nature of the injuries cannot be ascertained because certificate is not available. 6.
It is pointed out by learned A.P.P that two offences are pitted against the applicant as his criminal antecedents. It is further contended that applicant is a member of the gang, which has established terror in the vicinity of M.I.D.C. Walunj. In the absence of any direct incriminating material against the applicant, it is not possible to deny him bail. By imposing stringent conditions, he can be enlarged on bail. 7.
Bail Application is allowed.

The applicant shall be released on bail in connection with Crime No. 21/2026 registered with M.I.D.C., Walunj Police Station, Dist. Chhatrapti Sambhajinagar for the offences punishable under Sections 109, 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023, under Section 4/25 of the Arms Act, and under Section 135 of Maharashtra Police Act, on following conditions: (a) The applicant shall furnish P.R. bond of Rs. 25,000/- (Rs. Twenty Five Thousand only) with one solvent surety of like amount.
(b) The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses in any manner.
(c) The applicant shall stay away from entire Chhatrapati 2/3
Sambhajinagar Taluka till filing of the charge-sheet. (f) The applicant shall furnish his mobile/cell number and address to the investigating officer.
(h) The applicant shall report MIDC police station on every Sunday and Thursday between 10 a.m. to 4 p.m. till filing of the charge-sheet.
