The applicant is seeking regular bail in connection with Crime No. 384/2025, registered with Kotwali Police Station, District Parbhani, for the offences punishable under Sections 109(1), 118(1), 118(2), 115(2), 352, 351(3), 3(5) of Bharatiya Nyaya Sanhita, 2023. 3.
The injured-informant has reported to the police that applicant had teased him and a complaint was made by him to the father of the applicant. The applicant is alleged to have taken revenge of the complaint made by the applicant by assaulting him on 06.09.2025 at about 8 p.m. at old Pedgaon road Parbhani. The applicant is alleged to have assaulted by kicks and blows and thereafter by knife, along with his two friends. Informant is said to have sustained injuries on his head and collapsed. He is recorded to be shifted to the hospital. In pursuance of registration of the offence, the 1/3
applicant was arrested on 07.09.2025. The charge-sheet is filed on 15.11.2025.

Learned counsel for the applicant submits that he is falsely implicated in the offence. The injury certificate does not support prosecution case. The eye witnesses are unreliable because those are from different villages of the area. It is impossible for them to be present at the relevant time. 5.
Per contra, learned A.P.P. would submit that the applicant is a historysheeter and there are as many as five serious offences reported against him. He has assaulted the informant on vital part of the body by knife. The weapon is recovered and weapon query analysis supports the prosecution case. My attention is adverted to the statement of the eye witnesses Krishna, Kedar and Shivaji, which are consistent.

It reveals from the first information report that informant was attacked by the applicant and his friends in the dark at about 8 p.m. on 06.09.2025. The applicant is alleged to have assaulted by fist and blows and thereafter by knife. The blow by knife was missed and landed on the head. I have gone through the Medico Legal Certificate, which discloses two simple injuries. One is recorded to be on occipital region and another on chest by hard and blunt object. The injuries are not shown to have been caused by any sharp weapon. Prima facie, the injuries do not correspond to the prosecution theory. The informant is not seriously injured in the incident in question.

I have gone through the statements of the eye witnesses Krishna, Kedar and Shivaji. Those are consistent and would show involvement of the applicant. There are in all five offences pitted against the applicant. 8.
Considering the overall circumstances and the gravity of the allegations, I find that confinement from 07.09.2025 is sufficient one. Further detention is not required. Stringent conditions can be imposed to curtail probable mischief of the applicant.

The Bail Application is allowed.

The applicant Pawan Ashok Shinde, shall be released on bail in connection with Crime No. 384/2025, registered with Kotwali Police Station, District Parbhani, for the offences punishable under Sections 109(1), 118(1), 118(2), 115(2), 352, 351(3), 3(5) of Bharatiya Nyaya Sanhita, 2023 on following conditions:
(a) The applicant shall furnish P.R. bond of Rs. 50,000/- (Rs. Fifty Thousand only) with one solvent surety of like amount.
(b) The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses. (c) The applicant shall furnish his mobile/cell number and address to the investigating officer.
(d) The applicant shall not enter entire Parbhani Taluka, till conclusion of the trial, save and except for attending the trial.
(e) The applicant shall surrender his Aadhar Card and PAN card to the investigating officer.
(d) The applicants shall drop a Google pin location from his mobile phone to the IO concerned so as to show his whereabouts everyday.
(e) The applicant shall not indulge in any act or omission that is unlawful, illegal or that would prejudice the proceedings in pending cases, if any.
