The applicant is seeking regular bail in connection with Crime No.012 of 2026, registered with City Chowk Police Station, District - Chhatrapati Sambhajinagar Urban for the offences punishable under Section 326(g), 331(4) of Bharatiya Nyaya Sanhita, 2023, under section 3, 4 of Prevention of Damage to Public Property Act, 1984.

It is alleged that applicant is involved in setting part of the office of the SubRegistrar at Chhatrapati Sambhajinagar on fire. He was found to be in a suspicious condition, which is supported by CCTV footage collected during the course of investigation. He is arrested on 11.01.2026. During pendency of present application, chargesheet has been filed. 4.

Learned counsel for the applicant submits that there is no direct incriminating material against his client. He is implicated on suspicion only. It is 1/3

2 453-2026 submitted that any condition be imposed.

APP would point out that two offences are registered against the applicant and he is repeatedly indulging in the overt acts. His father was employee and taking dis-advantage of that, the applicant could get the accused to the office. It is submitted that during the search and seizure, objectionable material is found. Statement of the witnesses and CCTV footage would support the prosecution case.

There is no direct evidence against the applicant. His participation revealed during the course of investigation when CCTV footage was collected. It revealed that on 10.01.2026, at 4:45 am, a person of having identical stature as that of the applicant, was found to have been loitering suspiciously, holding a bag. The statement of the witnesses, seizure panchanama and house seizure panchanama would indicate some objectionable material against the applicant. I have reservations that as to whether the objectionable material is in respect of the offence in question or not. I find substance in the submission that merely on the ground of suspicion, applicant is found to have been implicated. 7.

Applicant is behind bars since 11.01.2026. Investigation is over. He is ready to stay away from entire Chhatrapati Sambhajinagar District till conclusion of the trial. Two criminal antecedents reported against him are not sufficient to deny bail.

I, therefore, pass the following order :-

ORDER

I] The Bail Application is allowed.

II] The applicant shall be released on bail in connection with Crime No. 012 of 2026, registered with City Chowk Police Station, District - Chhatrapati Sambhajinagar Urban for the offences punishable under Section 326(g), 331(4) of Bharatiya Nyaya Sanhita, 2023, under section 3, 4 of Prevention of Damage to Public Property Act, 1984, on following conditions: 2/3

3 453-2026 (a)The applicant shall furnish P.R. bond of Rs.30,000/- (Rs. Thirty Thousand only) with one solvent surety of like amount. (b)The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.

(c)The applicant shall furnish his mobile/cell number and address to the investigating officer.

(d) The applicant shall not enter the entire Chhatrapati Sambhajinagar District, till the conclusion of the trial. (e) The applicant shall surrender his Adhaar / PAN Cards, if any, to the Investigating Officer.

(f) The applicant shall co-operate for expeditious disposal of the trial.

(g) The applicant shall not indulge in similar type of offence. (h) His further overt act would entail cancellation of bail granted by this Court.
