Heard both sides. Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 33/2026 registered with Kranti Chowk Police Station, Chha. Sambhajinagar, Dist. Chh. Sambhajinagar (Aurangabad) for the offences punishable U/Sec. 69, 89, 115(2), 127(2), 351(2), 352 of the Bhartiya Nyay Sanhita. 2.
Applicant is arrested on 21.02.2026. The investigation is going on and charge sheet is yet to be filed. He is unsuccessful in his attempt to secure bail before the Sessions Court. 3.
Applicant is alleged to have lured the informant and under
2 915 ba 495.26 the pretext of marriage kept sexual relations with her. She was forced to terminate the pregnancy also. Thereafter he started to refuse to respond her. It is alleged that on 18.02.2026, applicant threatened her to upload the photographs on social media. 4.
Learned counsel for the applicant submits that the averments of the first information report show that informant had given consent and thereafter there were differenes. There was no contact from 17.06.2025 to 18.02.2026 between them, which appears to be unnatural. Its case of false implication. 5.
Learned Addl. P. P. submits that investigation is still going on. The statements of the witnesses would disclose involvement of the applicant in the offence. The overt act further manifested by statement of one of the witnesses. The witness is a person with whom she was going to be married after leaving the applicant. The statement shows that applicant is contacting the prosecutrix, which has spoiled her proposed marriage. 6.
I have considered rival submissions of the parties. Prosecutrix is major. The first contact between them was established on 17.03.2025. She was required to be aborted. Thereafter there was no contact between 17.06.2025 to 18.02.2026. Prima facie, no case is made out to attribute offence of rape.

The allegations that applicant is further contacting and harassing can be gone into during the course of trial. His further detention is not required during the course of the investigation. I, therefore, pass following order.
O R D E R
A.
The bail application is allowed.
B.
Applicant - Zulfekhar Mukhtar Ansari shall be released on bail in respect of Cr. No. 33/2026 registered with Kranti Chowk Police Station, Chha. Sambhajinagar, Dist. Chh. Sambhajinagar (Aurangabad) for the offences punishable U/Sec. 69, 89, 115(2), 127(2), 351(2), 352 of the Bhartiya Nyay Sanhita on condition of furnishing P. R. bond and S. B. of Rs. 40,000/- (Rs. Forty thousands only) with one solvent surety of like amount. C.
The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
D.
The applicant shall cooperate in expeditious disposal of the trial.
E.
The applicant shall surrender his Aadhar and Pan cards to the investigating officer.
F.
The applicant shall report the investigating officer on every Saturday between 10.00 am to 5.00 pm till conclusion of the

Bail application is disposed of.
