The applicant is seeking regular bail in connection with Crime No. 307 of 2025 registered with Upnagar Police Station, District - Nandurbar for the offences punishable under section 318(4), 351(2), 351(3), 61(2), 238 of Bharatiya Nyaya Sanhita, 2023, under section 66(c), 66(d) of Information Technology Act. 3.
A report is lodged that the SIM card sellers of Vodafone Idea are committing overt acts by generating SIM cards and activating them. Applicant is also one of the accused persons, who colluded with unknown culprits. He is stated to be the Territorial Sales Manager at the relevant time. He is alleged to have supplied SIM cards and logged in by obtaining OTP from others. He is arrested on 09.12.2025. Charge-sheet is filed. 1/3

Learned counsel for the applicant submits that no incriminating material is collected against him. He was at the relevant time employee of the Vodafone company. He performed his official duties by supplying the SIM cards and activating the user's accounts. He has not been unduly benefited. He is not responsible for opening of various bank accounts. 5.
Learned APP would oppose the submissions and submits that applicant was holding a responsible post at the relevant time. Money trail is found in between him and accused no. 10, who happens to be brother of the main accused no.1. His bank account statement shows that he was extended the benefit. 6.
I have considered the rival submissions of the parties. FIR does not spell out any overt act of the applicant. Applicant was working as Territorial Sales Manager of the Vodafone Company at the relevant time. Being Sales Manager, he had to perform the duties so as to promote the sales of SIM cards. The activity, per se cannot be termed to be overt act. The alleged money trail between him and accused no. 10 bears meager amount, as compared to the amount of defalcation. No specific incriminating role is surfacing. Statement of Faizal indicates that the role of the applicant was of accessing the account by obtaining the POS ID.

Prima facie, there is no material to corroborate the allegations against the applicant. It would be a matter of trial to examine as to how the applicant is being benefited and as to whether he is party to the conspiracy. There is sufficient incarceration. The investigation is over. No antecedents are reported against him. I am inclined to grant bail.

Hence, the following order :- I] The Bail Application is allowed.
II] The applicant shall be released on bail in connection with Crime No.307 of 2025 registered with Upnagar Police Station, District - Nandurbar for the offences punishable under section 318(4), 351(2), 351(3), 61(2), 238 of Bharatiya Nyaya Sanhita, 2023, under section 66(c), 66(d) of Information Technology Act, on following conditions:

3 497-2026 (a)The applicant shall furnish P.R. bond of Rs.30,000/- (Rs. Thirty Thousand only) with one solvent surety of like amount. (b)The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
(c)The applicant shall furnish his mobile/cell number and address to the investigating officer.
(d) The applicant shall surrender Adhaar / PAN cards, if any, to the Investigating Officer.
(e) The applicant shall co-operate for expeditious disposal of the trial.
