The applicants are seeking bail in respect of offence bearing Crime No.101 of 2026, registered with Shirdi Police Station, District Ahilyanaggar for the offences punishable
under Sections 109(1), 189(2), 189(3), 190, 191(2), 115(2) of Bhartiya Nyaya Sanhita.

They are involved in the incident dated 07.02.2026 for the offence of assault by fists and blows, intimidation in which the injures are inflicted to the informant. The name of the applicant Abhi @ Abhishekh is not spelt out in the First Information Report. Both the applicants are named in the statements of the eye witnesses recorded during the course of investigation.

Learned counsel for the applicants submits that they are falsely implicated in the offence. The allegations attributable to them are not serious in nature. There are no antecedents. The investigation is almost over. It is tried to be contended that there is settlement between informant and applicant Abhi @ Abhishekh.

Per contra, learned APP would point out the statements of the eye witnesses Israj, Daud Khan, Raju and Irfan which shows involvement of the applicants. It is submitted that the injury certificate discloses grievous injuries. The investigation is under way and the applicants are threatening the witnesses.

I have gone through First Information Report and the statements of the eye witnesses. At this juncture, presence of the applicants at the relevant time cannot be disputed. They were not armed with weapon. They participated in a free fight without any premeditation. The dispute initially started between Aditya Karale and Rushi Pardhe. Applicants are said to be the companions of main perpetrator Zingya @ Aniket Shejwal.

I have gone through injury certificate. There are in all five injuries. Out of them, two are grievous. There is no material on record to show that grievous injuries are caused at the instance of the applicants. They are entitled to be released on bail. I, therefore, pass following order :
O R D E R
(i) Bail Applications are allowed.
(ii) Applicant SALMAN JAMIR SHAIKH in Bail Application No.545 of 2026 and ABHI ALIAS ABHISHEKH VINOD SHEJWAL in Bail Application No.507 of 2026 shall be released on bail in Crime No.101 of 2026, registered with Shirdi Police Station, District Ahilyanaggar for the offences punishable under Sections 109(1), 189(2),
189(3), 190, 191(2), 115(2) of Bhartiya Nyaya Sanhita on furnishing P. R. bond of Rs.15,000/- (Rupees fifteen thousands only) each with one solvent surety of like amount each on the following conditions :
(a) The applicants shall not tamper the prosecution evidence and shall not contact the prosecution witnesses, in any manner.
(b) The applicants shall report the Investigating Officer on every Wednesday between 10.00 a.m. to 3.00 p.m. till filing of the chargesheet. (c) The applicants shall co-operate the Investigating Officer for furnishing any information, if required.
(iii) Bail applications are disposed of accordingly. (iv) Criminal application to assist APP is disposed of accordingly.
