IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 50 BAIL APPLICATION NO. 532 OF 2026 SUWARNA BHAGWAT DOIPHODE

VERSUS

THE STATE OF MAHARASHTRA WITH CRIMINAL APPLICATION NO. 1516 OF 2026 IN BA/532/2026 ...

Advocate for Applicant : Mr. Jadhavar Aashish T. APP for Respondent/s-State : Mr. G. O. Wattamwar. Advocate for Applicant to Assist APP : Mr. P. P. Giri. ...

CORAM : SHAILESH P. BRAHME, J.

DATE : 21.04.2026 PER COURT :- 1.

Heard both sides.

2.

The applicant is seeking bail in respect of offence bearing Crime No.65 of 2026, registered with Neknoor Police Station, District Beed, for the offences punishable under Sections 115(2), 118(1), 118(2), 351(2), 352, 3(5) of Bharatiya Nyaya Sanhita.

3.

Applicant is alleged to be involved in the quarrel between two couples who are the neighbours and residing at village Doifodwadi, Taluka and District Beed. It is alleged that informant's brother's wife Meerabai was the neighbour of

applicant. Her husband is dead. On 12.02.2026 there was quarrel between the neighbours on the count of construction and sprinkling of cement. Applicant's husband alleged to have assaulted Meerabai and the informant by iron rod. Applicant is alleged to have dragged Meerabai and assaulted by fists and blows. In pursuance of the offence, applicant is arrested on 24.02.2026. Charge-sheet is filed on 27.03.2026. 4.

Learned counsel for the applicant submits that a totally false complaint is filed to counterblast offence registered at the instance of applicant bearing Crime No.61 of 2026. In that offence informant Babasaheb outraged the modesty of the applicant and assaulted the present applicant on 12.02.2026, at 6.30 p.m. The allegations are not serious in nature. The investigation is over and there is no point in keeping the applicant behind bar.

5.

Per contra, learned APP submits that the prosecution has collected clinching material against the applicant and coaccused. The Medico Legal Certificates would support the prosecution case.

6.

Learned counsel Mr. Giri while assisting APP submits that no case is made out for enlarging the applicant on bail.

7.

Before registering offence bearing Crime No.65 of 2026, offence bearing Crime No.61 of 2026 was registered at the instance of applicant against Babasaheb, Ashwini (wife of Babasaheb) and Meerabai. It is stated in the complaint that at the relevant time, co-accused, Meerabai, assaulted present applicant and Babasaheb outraged her modesty. 8.

It's a case of cross complaint. The possibility of filing present complaint to counter blast earlier offence cannot be ruled out. With the assistance of learned APP, I have gone through Medico Legal Certificates of Babasaheb and Meerabai. Babasaheb is shown to have sustained two simple injuries and one grievous injury. Meerabai is shown to have sustained two simple injuries. They are the neighbours and the implication is because of construction.

9.

Considering the gravity and overall circumstances, I am inclined to grant bail. I, therefore, pass the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SUWARNA BHAGWAT DOIPHODE shall be released on bail in Crime No.65 of 2026, registered with Neknoor Police Station, District
