Heard both sides. Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 11/2024 registered with Bhada Police Station, Tq. Ausa, Dist. Latur for the offences punishable U/Sec. 302, 326, 341, 323, 504, 506, 143, 147, 148, 149 r/w Sec. 34 of the Indian Penal Code and Sec. 135 of the Bombay Police Act.

The applicant is arrested on 23.05.2024. Charge sheet is filed on 10.08.2024. It is specific allegation that members of the More family and Mule family have adjoining lands at village Sindala, Tq. Ausa. They share common boundary. They have disputes over boundary of the lands and encroachment. Quarrel

2 44 BA 570.26 cropped up on the count of removing the soil and fight took place amongst the members of both families. Both sides were armed with weapon. Accused Chandrasen Mule alleged to have inflicted fatal blow on Vilas More. Co-accused Parmeshwar Mule also assaulted him by knife. He succumbed to injuries. Applicant is said to have assaulted by fist and blows. He is alleged to have assaulted Anant Gopal More by iron rod. 3.

Learned counsel for the applicant submits that he is entitled to be released on bail on the ground of parity. The allegations against the applicant are not serious in nature. There are no criminal antecedents. The charge has also not been framed. Applicant's daughter was found missing and report to that effect was lodged on 20.02.2026. Lateron she was found dead. It is additional reason why applicant needs to be released on bail.

Per contra, learned A. P. P. points out that there are seven eye witnesses to the incident, which are consistent for attributing overt act against the applicant. It is submitted that in all five injuries are inflicted by the applicant on the person of Anant Gopal More. Those are grievous in nature. Applicant is facing serious allegations.

Applicant's earlier application was permitted to be withdrawn by High Court on 11.12.2025. The charge has not been framed by the Sessions Court. The co-accused Kamlakar

3 44 BA 570.26 was enlarged on bail on 19.09.2025. These supervening events would permit this Court to examine the matter on merits. 6.

The first information report and the statements of the witnesses go to show that applicant assaulted members of the rival group by kicks, blows and stick. This type of allegation is vague in nature because same role is attributed to other persons also. Only specific role attributed to applicant is assault by iron rod on Anant Gopal More. I have gone through medico legal certificate of Anant. In all 05 injuries are reported on his person. Two out of them are grievous in nature. There was free fight between members of the rival group. At this juncture it cannot be inferred that there was any mens rea for the applicant to commit murder of either Anant or any other person. 7.

It is not disputed that applicant's own daughter was missing and lateron found dead. Being father he is concerned with it. He needs to be released on bail to look after the family members or to set the law in motion. There is no point and purpose in detaining the applicant in jail. I, therefore, pass following order.

O R D E R

A.

The bail application is allowed.

B.

Applicant - Angad Trimbak Bhosale shall be released on bail in respect of Cr. No. 11/2024 registered with Bhada Police

Latur for the offences punishable U/Sec. 302, 326, 341, 323, 504, 506, 143, 147, 148, 149 r/w Sec. 34 of the Indian Penal Code and Sec. 135 of the Bombay Police Act on condition of furnishing P. R. bond and S. B. of Rs. 25,000/- (Rs. Twenty Five thousands only) with one solvent surety of like amount.

C.

The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.

D.

The applicant shall cooperate in expeditious disposal of the trial.

E.

The applicant shall surrender his Aadhar and Pan cards to the investigating officer.

F.

The applicant shall stay away from village till conclusion of the trial.

G.

The applicant shall give his mobile/cell number and address to the investigating officer.

H.

Bail application is disposed of.
