Heard both sides. Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 27/2026 registered with Peth Beed Police Station, Tq. & Dist. Beed for the offences punishable U/Sec. 109(1) of the Bhartiya Nyaya Sanhita, 2023 and Sec. 4 and 25 of the Arms Act and Section 135 of the Maharashtra Police Act.

It is alleged that applicant was III year student of B. Sc. Agriculture, who threatened the informant on 02.02.2026 in the college premises. Applicant is alleged to have inflicted injuries on the chest and hand of the informant by knife. He was apprehended there itself.

Learned counsel for the applicant submits that his client is falsely implicated in the offence. The investigation is almost over. No antecedents are recorded against him. He is already rusticated from the college. It is the informant who had threatened the applicant.

Learned A. P. P. would submit that there are eye witnesses. The injury certificate shows that two injuries were inflicted and one is grievous one. The knife is recovered at the instance of the applicant. The investigation is still going on. 5.
The plea taken up by the applicant that on previous occasion informant tried to threaten him appears to be improbable. Informant is student of I Year of B. Sc. Agriculture. The applicant is student of III year of B. Sc. Agriculture. First information report and the papers of investigation show that at the relevant time applicant was armed with weapon. Applicant is senior to the informant and appears to have shown his superiority or terror.

The injury certificate shows three simple and one grievous injuries. Prima facie, mens rea cannot be made out from the investigation conducted so far. He is already removed from the college. It is unexpected of a young person to indulge in such activities while taking education. But at the same time further detention is unwarranted. I, therefore, pass following order.

O R D E R
A.
The bail application is allowed.
B.
Applicant - Akshay Pramod Deshmukh shall be released on bail in respect of Cr. No. 27/2026 registered with Peth Beed Police Station, Tq. & Dist. Beed for the offences punishable U/Sec. 109(1) of the Bhartiya Nyaya Sanhita, 2023 and Sec. 4 and 25 of the Arms Act and Section 135 of the Maharashtra Police Act on condition of furnishing P. R. bond and S. B. of Rs. 20,000/- (Rs. Twenty thousands only) with one solvent surety of like amount.
C.
The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
D.
The applicant shall cooperate in expeditious disposal of trial.
E.
The applicant shall surrender his Aadhar and Pan cards to the investigating officer.
F.
The applicant shall stay away from entire Beed district till conclusion of the trial, save and except attending the date of Trial.
G.
The applicant shall give his mobile/cell number and

H.
The applicant shall report to the investigating officer on every Sunday between 10.00 am to 3.00 pm till filing of the charge sheet.
