The applicant is seeking regular bail in connection with Crime No. 287/2025, registered with Karmad Police Station, District Chh.Sambhajinagar, for the offences punishable under Section 309 (6), 310(2) of Bharatiya Nyaya Sanhita, 2023.

The applicant is arrested on 03.07.2025. Charge-sheet is filed on 25.09.2025.

The applicant is involved in offence of robbery as is reported by one Vijay Ukirade. His shop was trespassed in wee hours on 03.07.2025. It is 1/3

alleged that the applicant along with other persons broke open the shop and when the informant heard the noise he intimated other persons. They tried to catch the persons. Two of them were apprehended and others fled away. The applicant is one of the apprehended person. It is alleged that cash of Rs. 2000/- was taken away from the counter of the shop. 5.

Learned counsel for the applicant submits that there is no need for further detention. The supplementary statement has implicated five persons deliberately. The recovery is at the instance of the co-accused. 6.

Per contra, learned A.P.P. submits that there are three eye witnesses who are consistent. The applicant and co-accused were apprehended with cash. The applicant is said to be a history sheeter because three similar types of offences are registered against him. 7.

First information report and the statements of the witnesses indicate that applicant and co-accused Umesh were apprehended and cash of Rs. 2000/- was recovered from them. The injury certificate of informant shows simple injury. It is not a case that the applicant was armed with deadly weapon and caused serious injury to the person, who approached him for arresting.

Considering the material collected during the course of investigation and the allegations, I find that the applicant is entitled to be released on bail. Habitual tendency cannot be overlooked. 9.

The Bail Application is allowed.

The applicant Krushna Narayan Bhosale shall be released on bail in connection with Crime No. 287/2025, registered with Karmad Police Station, District Chh.Sambhajinagar, for the offences punishable under Section 309 (6), 310(2) of Bharatiya Nyaya Sanhita, 2023. on following conditions:

(a) The applicant shall furnish P.R. bond of Rs. 20,000/- (Rs. Twenty Thousand only) with one solvent surety of like amount.

(b) The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses. (c) The applicant shall furnish his mobile/cell number and address to the investigating officer.

(d) The applicant is prohibited from entering Taluka Newasa, Rahuri and Karmad, till conclusion of the trial. (e) The applicant shall not indulge in similar type of offence, in default, would entail cancellation of bail without reference to the Court.
