The applicant is seeking regular bail in connection with Crime No.369 of 2025, registered with Chalisgaon Police Station, Dist. Jalgaon for the offences punishable under Section 109, 351(3), 238, 3(5) of Bharatiya Nyaya Sanhita, 2023, under section 4/25 of Arms Act, under section 7 of Criminal Amendment Act, under section 37(1)(3), 135 of the Maharashtra Police Act. 3.
The applicant is behind bars since 30.08.2025 and charge-sheet is filed. 4.
Reliance is placed by learned counsel for the applicant Mr. Ghanekar on order dated 26.03.2026 passed in Bail Application No. 380 of 2026, releasing 1/3
2 684 - 2026 Shivaji @ Nana Suresh Patil. The role attributed to the applicant is identical. Applicant is stated to have been falsely implicated in the offence. 5.
Application is contested by learned APP. She would submit that applicant was armed with the weapon and his involvement is made out from the statement of witnesses. There is cogent material against the applicant. 6.
I have gone through the order dated 26.03.2026, enlarging Shivaji @ Nana Suresh Patil on bail. FIR does not spell out involvement of the applicant. The supplementary statement shows the presence of the applicant along with coaccused. His role is further disclosed in the statement of the victim. I find that role attributed to the applicant is at par with the role of main accused - Shivaji @ Nana Suresh Patil, who is enlarged on bail. No startling circumstances have been pointed out against the applicant. No antecedents are against him. I propose to adopt the same reasons as in the case of Shivaji @ Nana Suresh Patil. 7.
I, therefore, pass the following order :-
ORDER
I] The Bail Application is allowed.
II] The applicant shall be released on bail in connection with Crime No.369 of 2025, registered with Chalisgaon Police Station, Dist. Jalgaon for the offences punishable under Section 109, 351(3), 238, 3(5) of Bharatiya Nyaya Sanhita, 2023, under section 4/25 of Arms Act, under section 7 of Criminal Amendment Act, under section 37(1)(3), 135 of the Maharashtra Police Act, on following conditions: (a)The applicant shall furnish P.R. bond of Rs.50,000/- (Rs. Fifty Thousand only) with one solvent surety of like amount. 2/3
3 684 - 2026 (b)The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
(c)The applicant shall furnish his mobile/cell number and address to the investigating officer.
(d) The applicant shall co-operate for expeditious disposal of the trial.
(e) The applicant shall stay away from Chalisgaon Taluka, Dist. Jalgaon till conclusion of the trial save and except attending the trial.
(f) The applicant shall surrender his Adhaar / PAN Cards, if any, to the Investigating Officer.
