The applicant is seeking bail in respect of offence bearing Crime No.52 of 2016, registered with MIDC Paithan Police Station, District Chh. Sambhajinagar for the offences punishable under Sections 399, 402 of the Indian Penal Code. 3.

It is reported by the Police Sub Inspector that the patrolling squad received secret information that some persons were attempting to commit dacoity. Accordingly, on 17.03.2016, one person was apprehended. The others fled away. Lateron, applicant was arrested on 21.10.2024. It is disclosed that applicant and co-accused have been indulging in road robbery and dacoity persistently. One of them is found to

be in possession of weapon and objectionable material. The charge-sheet was filed and application was rejected by the Sessions Court. Thereafter, applicant had preferred application in High Court which was rejected on 16.01.2025. Suppressing the order of the High Court, order of bail was secured from the Sessions Court on 14.02.2025. No sooner than the suppression was disclosed, the order was recalled on 28.02.2025. Thus, applicant remained in the custody.

Learned counsel submits that the investigation is over and he be released on bail by imposing certain conditions. 5.

Learned APP would submit that he is a history-sheeter and there are four offences reported against him. The incriminating material is collected against applicant and the co-accused.

Considering the allegations in the FIR and the papers of investigation, I find that further incarceration is not required. The investigation is over. The tendency of the applicant can be looked after by imposing the conditions. I, therefore, pass the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SHAKIN ALIAS SHAKIL MOMIN CHAVAN shall be released on bail in Crime No.52 of 2016, registered with MIDC Paithan Police Station, District Chh. Sambhajinagar for the offences punishable under Sections 399, 402 of the Indian Penal Code, on furnishing P. R. bond of Rs.20,000/- (Rupees twenty thousands only) with one solvent surety of like amount on the following conditions :

(a) The applicant shall not tamper with the prosecution evidence or contact with the prosecution witnesses.

(b) The applicant shall co-operate for expeditious disposal of the trial and shall not commit any default in attending the trial.

(c) The applicant shall not indulged in any offence. The default thereof would lead to cancellation of bail without reference to the Court.

(d) The applicant shall surrender his Aadhar Card and PAN Card to the Investigating Officer, if any.

(iii) Bail application is disposed of accordingly.
