Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 304/2024 registered with Murud Police Station for the offences punishable U/Sec. 3(5) and 103(1) of the Bhartiya Nyay Sanhita, 2023.

He is arrested on 22.03.2025. The charge sheet is filed on 03.12.2024.

It is reported to the police by the father of the deceased that deceased Amit Bansode was having illicit relations with the
2 34 ba 701.26 wife of accused No. 1 - Sunil Datta Alte and there used to be quarrel in the family on that count. The deceased Amit met informant lastly on 07.09.2024 in the night. He did not came home. On the next day morning informant started searching him. It was reported that a dead body of Amit was found in the forest of Murud.

Learned counsel for the applicant submits that unidentified person committed murder and applicant is made scape goat for no reason. The witnesses have been examined before the Trial Court. Informant and Vishnu Kalase are not supporting the prosecution theory. No motive can be attributed to the applicant. The statement of Vishnu Kalase and Vijay Chandrakant Ajagare are not in the form of extra judicial confession, which has no probative value. There is no material to connect the applicant with the commission of crime. 6.
Learned A. P. P. would submit that the trial is under way and already five witnesses have been examined. There is no reason to cause indulgence at this stage of the proceeding. Applicant along with co-accused has committed serious offence and the material to that effect is collected by the respondent. 7.
The motive can be attributed to the accused No. 1 - Sunil as the deceased was having illicit relations with his wife. Informant did not support the motive in his deposition before the Trial Court. A copy of the deposition is placed on record. My
3 34 ba 701.26 attention is also adverted to the deposition of Vishnu Kalse, who is declared to be hostile and permission was granted to the Public Prosecutor to cross examine him. The important witnesses are not supporting the prosecution theory.

There is no direct evidence against the applicant. No material is pointed out to show that there was meeting of mind and common object for the applicant and co-accused to eliminate Amit. In all twenty one witnesses are cited by the prosecution. Some time is likely to consume for conclusion of trial. I find that applicant is entitled to be released on bail. I, therefore, pass following order.
O R D E R
A.
The bail application is allowed.
B.
Applicant - Parmeshwar Dagdu Dhobale shall be released on bail in respect of Cr. No. 304/2024 registered with Murud Police Station for the offences punishable U/Sec. 3(5) and 103(1) of the Bhartiya Nyay Sanhita, 2023 on condition of furnishing P. R. bond and S. B. of Rs. 30,000/- (Rs. Thirty thousands only) with one solvent surety of like amount.
C.
The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
D.
Applicant shall attend every date of trial punctually and

The applicant shall surrender his Aadhar and Pan cards before the Investigating Officer.
F.
The applicant shall furnish his mobile/cell phone number and address to the Investigating Officer.

Bail application is disposed of.
