The applicant is seeking enlargement on bail in connection with Crime No.259 of 2025, registered with Nandurbar Police Station, Dist. Nandurbar for the offences punishable under Section 310(2), 115(2), 351(2) of Bharatiya Nyaya Sanhita, 2023.

The applicant is behind bars since 31.07.2025. 4.
Learned counsel for the applicant submits that he is relying upon order dated 12.01.2026 passed by Co-ordinate Bench in BA / 2338 / 2025, enlarging coaccused Polister Kamansingh Pawar, on bail. There is delay of one month in registering the offence. The identification parade conducted by the Investigating Officer is vulnerable. Further custody of the applicant is not required. 5.
APP refutes the submissions, mainly on the ground that in test identification parade, applicant has been identified. There is recovery of mobile 1/3
2 706 - 2026 handset of the informant at his instance. The papers of the investigation disclose the involvement of the applicant. One more offence is pitted against him. 6.
Applicant is alleged to have committed robbery worth Rs.7,45,000/-. The informant and his companion had been to Dondaicha to inspect the scrap material before purchasing. They were taken to Saitne wherein unidentified persons intercepted and apprehended them. One of them was having a knife and the robbery is committed.

I have gone through the order passed by the Co-ordinate bench in granting relief to the co-accused Polister. The role attributed to the present applicant is identical to that of Polister. The recovery of mobile has been made from the applicant. The recovery is a part of the investigation. He is also stated to have been identified. This aspect of the matter can be looked into during course of the trial. The applicant is behind bars for sufficient period. His further detention is not warranted.

I, therefore, pass the following order :- I] The Bail Application is allowed.
II] The applicant shall be released on bail in connection with Crime No. 259 of 2025, registered with Nandurbar Police Station, Dist. Nandurbar for the offences punishable under Section 310(2), 115(2), 351(2) of Bharatiya Nyaya Sanhita, 2023, on following conditions:
(a) The applicant shall furnish P.R. bond of Rs.50,000/- (Rs. Fifty Thousand only) with one solvent surety of like amount. (b) The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
(c) The applicant shall furnish his mobile/cell number and address and two of the near relatives to the investigating officer. (d) The applicant shall surrender Adhaar / PAN Cards, if any, to the Investigating Officer.
(e) The applicant shall attend the trial on each and every date unless exempted by the trial Court.

3 706 - 2026 (f) In case of breach of any of the conditions by the applicant, it is open for the prosecution to move the concerned Court seeking cancellation of bail.
(g) Needless to state that the observations rendered herein are to the extent of this application and the trial Court shall not be influenced by the same.
