The applicant is seeking bail in respect of offence bearing Crime No.628 of 2025, registered with Dhule Taluka Police Station, District Dhule, for the offences punishable under Sections 64(2)(m), 115(2), 352, 351(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita.

Respondent No.2 is served and the lawyer representing her supports the claim of the applicant. Respondent No.2 is major, married and mother of two children. It is contended that there is amicable settlement and due to misunderstanding the offence has been lodged with the Police Station.

It is reported to the police that respondent No.2 was married but she left company of her husband and children and joined the accused Rahul who eloped her with promises of marriage. During their association, the sexual relation established many times. Applicant and co-accused have alleged to have abused and assaulted her. They are alleged to have raped her by giving threats to make her obscene photographs viral.

The applicant is arrested on 19.10.2025. Charge-sheet is filed on 15.12.2025.

Learned APP would oppose the application. It is submitted that applicant cannot be enlarged on bail due to any settlement between the parties. The time and energy is spent in conducting the investigation.

Applicant is original accused No.3. The victim is alleged to have eloped with accused No.1 Rahul. There is ample evidence to show that the relationship was consensual. The victim is presently staying with accused No.1 Rahul voluntarily. She has no grievance against the present applicant.

Learned counsel for the applicant voluntarily agrees on instructions of her client to deposit Rs.10,000/- towards the cost with Dhule Police Welfare Fund.

In view of the above discussion, I am inclined to grant bail to the applicant. Hence, I pass the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant KRISHNA ALIAS KANHA KIRAN MORE shall be released on bail in Crime No.628 of 2025, registered with Dhule Taluka Police Station, District Dhule, for the offences punishable under Sections 64(2)(m), 115(2), 352, 351(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita, on furnishing P. R. bond of Rs.20,000/- (Rupees twenty thousands only) with one solvent surety of like amount on the following conditions :
(a) The applicant shall not tamper with the prosecution evidence or contact with the prosecution witnesses.
(b) The applicant shall co-operate for expeditious disposal of the trial and attend the dates punctually.
(c) It shall be open for the applicant to deposit Rs.10,000/- with Dhule Police Welfare Fund by crediting the same with the account furnished by the Investigating Officer within a period of four (4) weeks from today.
(iii) Bail application is disposed of accordingly.
