Applicant is arrested on 02.11.2025 in furtherance of offence bearing Cr. No. 441/2025 registered with Shillegaon Police Station, Tq. Gangapur, Dist. Chhatrapati Sambhajinagar for the offences punishable U/Sec. 64, 65(1), 74, 75(2), 351(2), 49 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Sec. 4, 6, 8, 12 and 27 of the Protection of Children from Sexual Offices Act, 2012 and Sec. 9, 10 and 11 of the Prevention of Child Marriage Act, 2006. The investigation is over and still he is behind bars.

Learned counsel for the respondent No. 2 has tendered on record affidavit of the guardian who is looking after the victim and in whose custody the victim is residing, consenting for enlarging applicant on bail.

Learned counsel for the applicant as well as the respondent No. 2 on instructions of their clients would submit that after completion of the 18 years of the victim, they are ready to cohabit. They further confirm that disputes have been amicably settled, notwithstanding the legal consequences. 5.

I have gone through the first information report disclosing the marriage performed by the applicant with the victim, who is under age. The relatives of the applicant have also been added in the crime. Considering peculiar allegations and facts and circumstances of the case, I find it fit to enlarge the applicant on bail.

No antecedents are reported against the applicant. There is possibility of cohabitation if it is permissible in law. It is likely to mitigate the miseries of the victim. I, therefore, pass following order.

O R D E R

A.

The bail application is allowed.

B.

Applicant - Pravin Chandrabhan Gore shall be released on

3 923 ba 778.26 bail in respect of Cr. No. 441/2025 registered with Shillegaon Police Station, Tq. Gangapur, Dist. Chhatrapati Sambhajinagar for the offences punishable U/Sec. 64, 65(1), 74, 75(2), 351(2), 49 and 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Sec. 4, 6, 8, 12 and 27 of the Protection of Children from Sexual Offices Act, 2012 and Sec. 9, 10 and 11 of the Prevention of Child Marriage Act, 2006 on condition of furnishing P. R. bond and S. B. of Rs. 30,000/- (Rs. Thirty thousands only) with one solvent surety of like amount.

C.

The applicant shall cohabit with the victim on attaining her age of majority as is permissible in law, which shall be without prejudice to the legal consequences against the applicant and the co-accused in Special Case No. 1197 of 2025. D.

The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.

E.

The applicant shall cooperate in expeditious disposal of the trial.

F.

The applicant shall surrender his Aadhar and Pan cards to the investigating officer.

G.

Bail application is disposed of.
