The applicants are seeking regular bail in connection with Crime No.029 of 2026, registered with Sakri Police Station, Dist. Dhule for the offences punishable under Section 103, 238, 3(5) of Bharatiya Nyaya Sanhita, 2023. 3.

The applicants happen to be residents of Maharana Pratap Chowk, Sakri, Tq. Sakri near the house of the informant. It is alleged that on 07.02.2026, at about 10.15 pm, there was commotion on the common terrace of the applicant and the informant. Few Adhivasi boys are seen to have been eloping. The 1/3

2 807 - 2026 people gathered at the spot. On the terrace, Shoeb Saeed Shaikh, nephew of the informant was found to have been lying in the pool of blood with severe injuries. The assault is alleged to have been made on count of theft and/or the disputes between the informant's son Noor and the deceased. Applicant is arrested on 08.02.2026, in pursuance of the offence.

Learned counsel for the applicants submits that the investigation is over and there is nothing incriminating against her clients. The case is based on circumstantial evidence and the implication is due to suspicion. Applicant was not present at the relevant time. No antecedents are reported against them. 5.

Learned APP would submit that the post-mortem report discloses 32 injuries. The statements have been recorded of the persons, who gathered at the relevant time. The knife was seized from the spot of incident. 6.

The FIR does not spell out any specific role and involvement of the applicants. It's a matter of fact that their houses are abutting and there was some issue between applicants' son Noor and the deceased. In all probability, false implication due to the disputes, cannot be ruled out. 7.

The recovery of the knife is from the spot of the incident. No incriminating material is pointed out to show that applicants have caused disappearance of any evidence. They are behind bars since 08.02.2026. 8.

Considering the overall circumstances, I am inclined to grant bail to the applicants.

I, therefore, pass the following order :-

ORDER

I] The Bail Application is allowed.

II] The applicants shall be released on bail in connection with Crime No.029 of 2026, registered with Sakri Police Station, Dist. Dhule for the offences punishable under Section 103, 238, 3(5) of Bharatiya Nyaya Sanhita, 2023, on following conditions:

(a)The applicants shall furnish P.R. bonds of Rs.30,000/- (Rs. Thirty Thousand only) each with one solvent surety each of like amount.

(b)The applicants shall not tamper with prosecution evidence or contact with the prosecution witnesses.

(c)The applicants shall furnish his mobile/cell number and address to the investigating officer.

(d) The applicants shall co-operate for expeditious disposal of the trial.

(e) The applicants shall surrender Adhaar / PAN Cards, if any, to the Investigating Officer.

(f) The applicants shall report the Investigating Officer on every Sunday between 10.00 am and 3.00 pm till filing of the chargesheet.
