The application pertains to offence bearing Crime No. 257 of 2022, registered with Kaij Police Station, District Beed, for the offences punishable under Sections 354-A, 354-B, 323, 506 of the IPC and Section 8, 12 of the POCSO Act. 3.

Applicant was enlarged on bail by Special Court on certain conditions vide order dated 04.01.2023. Due to persistent absence, Non Bailable Warrant was issued to the applicant on 05.02.2026. He was produced before the Court on 25.03.2026. He submitted application Exh.14 for releasing him on bail stating that for earning livelihood he was required

to move. The application was rejected. Hence, applicant is before this Court.

Application is contested by learned APP. It is submitted that applicant consistently remained absent and due to noncooperation, the warrant has required to be issued. He is involved in a serious offence. The victim's age is eight (8) years. It is prayed that instead of allowing application, trial be expedited.

Applicant was once released on bail on 04.01.2023. Learned counsel for the applicant makes a solemn statement on instructions that his client is ready to furnish undertaking that he shall attend the dates of the trial and co-operate for expeditious disposal. Considering the nature of allegations and readiness to furnish the undertaking, I propose to grant one chance to the applicant. I, therefore, pass the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SACHIN NARSU CHAUGHULE shall be released on bail in Crime No. 257 of 2022, registered with Kaij Police Station, District Beed, for the offences punishable under Sections 354-A,

354-B, 323, 506 of the IPC and Section 8, 12 of the POCSO Act on same conditions with fresh bond and surety. The following shall be additional conditions :

(a) The applicant shall furnish undertaking stating that he shall attend punctually every date of the trial and co-operate for expeditious disposal of the trial.

(b) The applicant shall furnish his contact numbers to the Investigating Officer and shall inform the Investigating Officer before moving out of the place of his residence.

(c) Any further default would entail the cancellation of bail.

(iii) Bail application is disposed of accordingly.
