Applicant is seeking enlargement on bail in respect of offence bearing Cr. No. 93/2026 registered with M.I.D.C. CIDCO Police Station, Chhatrapati Sambhajinagar for the offences punishable U/Sec. 140(3), 309(6), 124(2), 61(2), 49 r/w Sec. 3(5) of the Bhartiya Nyaya Sanhita, 2023. He is arrested on 12.04.2026. The investigation is underway.

Learned counsel for the applicant has placed reliance on the order dated 30.04.2026 passed by this Court in Bail Application No. 713 of 2026 releasing Rameshwar Sitaram Kale
2 921 ba 833.26 on bail under similar circumstances. Co-accused Santosh Pawar is also stated to be released on bail by Sessions Court. No antecedents are pitted against the applicant. There is absolutely no material and only because of some proprietary disputes against the informant, applicant is falsely implicated. The applicant is required to be released on bail. 4.
Learned A. P. P. Mr. Hange would submit that co-accused are still absconding. The stolen articles are yet to be recovered and investigation is still going on.

This Court had an occasion to examine the complaint while dealing with Bail Application No. 713 of 2026. The applicant in that case was unidentified person. There were no steps taken for identification of the co-accused. He was stated to be associated with Laxmanrao Pawar, who was at the logger head with the informant and, therefore, Rameshwar Kale was released on bail. 6.
In the present case, applicant cannot be said to be any unidentified persons who abducted the informant. There appears to be some proprietary dispute in between the applicants and the informant. No material is pointed out to disclose involvement and active participation of the applicant in abducting the informant. The implication is due to some rivalry and due to suspicion. No antecedents are reported against him. I, therefore, pass following order.

O R D E R
I.
The bail application is allowed.
II.
Applicant - Tejrao Laxman Kanhere shall be released on bail in respect of Crime No.93 of 2026, registered with M.I.D.C. CIDCO Police Station, Chhatrapati Sambhajinagar (Urban) for the offences punishable under Section 140(3). 309(6), 124(2), 3(5) of Bharatiya Nyaya Sanhita, 2023, on following conditions: (a) The applicant shall furnish P.R. and S. B. bond of Rs. 40,000/- (Rs. Forty Thousand only) with one solvent surety of like amount.
(b) The applicant shall desist from indulging in such type of activities.
(c) The applicant shall not tamper with prosecution evidence or contact with the prosecution witnesses.
(d) The applicant shall furnish his mobile/cell number and address to the investigating officer.
(e) The applicant shall co-operate for expeditious disposal of the trial.
(f) The applicant shall surrender Adhaar / PAN Cards, if any, to the Investigating Officer.
