The learned counsel for the applicant submits that the applicant has married the girl after completion of her age of 18 years. That, the girl was willing to perform the marriage. Not only that, after returning back from their elopement, the girl had also made a complaint to the Superintendent of Police, not to accept any complaint on behalf of her father. The photographs of the marriage as well as the marriage certificate issued by Sai Mangal Karyalaya, Alandi, Taluka Khked Dist. Pune, is also annexed alongwith the application. The learned counsel further submits that the offence was initially registered under Section 363 of IPC. After returning back, the accused was arrested and one day PCR was granted. The applicant was, thereafter released on bail.
It is further submitted that due to pressure of the family of the girl a supplementary statement of the girl was recorded and stringent sections of POCSO Act were thereafter added in the present crime.
{2} 911 sr.no...odt 19.12.2025 had cancelled the bail on the ground of stringent conditions of the POCSO Act. The applicant has already married the victim girl and is not a history-sheeter and is ready to abide by the conditions that may be imposed by this court.

Thus, taking into consideration the above submissions, I am inclined to protect the applicant till the investigation papers are seen. Hence, the following order :-
O R D E R
[I] In the event of arrest of the applicant, in connection with Crime No.309 of 2025 registered with Gondi Police Station, District Jalna, for the offences punishable under Sections 64(2)(m), 92, 142, 351(1)(2) of the Bhartiya Nyaya Sanhita and under Section 4, 5(1) and 6 of the POCSO Act, the applicant :- Amol Dattu Jadhav be released on bail on furnishing PR Bond in the sum of Rs. 50,000/-, with one or more sureties in the like amount, on the following conditions :- [i] The applicant shall attend the concerned police station and report to the Investigating Officer on 17th, 24th, 31st January, 2026 between 11.00 a.m. to 1.00 p.m. and shall cooperate with the investigation.
[ii] The applicant shall not tamper with the prosecution evidence and threaten the witnesses.
[iii] The Investigating Officer shall make investigation papers available on next date of hearing.
[iv] The applicant shall submit his Aadhar and Pan card to the Investigating Officer alongwith mobile numbers and addresses of two of his near relatives.
[v] Stand over to 4th February, 2026.
