Heard the learned Senior Counsel Mr. Rajendraa S. Deshmukkh for the Applicant.

Issue notice to the Respondents, returnable on 04.02.2026. Learned APP waives service of notice for Respondents/State. 3.

The learned Senior Counsel for the Applicant submits that this Court has already protected other accused advocates appearing in the case, which was found to have been fraudulently dealt with. The learned Senior Counsel further submits that the Applicant is a panel counsel for the National Highway Authority of India and is a whistle-blower who pointed out to the Collector the fraud attempted to be played upon the NHAI for extracting huge amounts through

2 908.ABA-61-2026.doc awards which were not in existence. This Court has already protected some of the accused persons vide order dated 23.12.2025 in ABA Nos. 2256/2025 and 2243/2025. The Applicant is deeply rooted in society, is a practicing advocate, and therefore not a flight risk. He is ready to abide by any conditions that may be imposed by this Court. 4.

Thus, taking into consideration the aforesaid submissions and also the fact that this Court has already protected some of the accused Advocates in ABA Nos. 2256/2025 and 2243/2025, I am inclined to protect the Applicant till the investigation papers are received. Hence the following order :

ORDER

(a) In the event of arrest of the Applicant - Mrigesh Dinkarrao Narwadkar in connection with Crime No.544/2025 registered with Shivajinagar Police Station, District Beed for the offences punishable under Sections 7 and 13 of Prevention of Corruption Act, 1988 and under Sections 14 and 34 of Arbitration and Conciliation Act, 1996 and under Sections 318(4), 316(5), 338, 336(3), 340(2), 198, 199, 316(2), 61 and 351(4) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousands) with two solvent sureties in the like amount, on the following conditions :

(b) The Applicant is directed to attend Shivajinagar Police Station, District Beed and report to the Investigating Officer as and when called.

(c) The Applicant shall also cooperate with the investigation.

3 908.ABA-61-2026.doc (d) The Applicant shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner. 5.

Needless to say, violation of any the aforesaid conditions may entitle the prosecution to seek vacation of the interim relief granted herein above.

The Investigating Officer is directed to remain present in the Court along with the investigation papers on the next date of hearing.

Stand over to 04.02.2026.
