Heard learned counsel for the applicant and the learned APP for the respondents - State.

Issue notice to the respondents, returnable on 10.02.2026. The learned APP waives notice on behalf of the respondents - State. 3.
The applicant has approached this Court apprehending arrest in connection with FIR No. 0545 of 2025 dated 01.12.2025, registered with Degloor Police Station, District Nanded, for the offences punishable under Sections 132, 74, 121(1), 296, 351(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 4.
Learned counsel for the applicant submits that the offences invoked by the complainant are triable by the Magistrate. It is 1/3
submitted that the applicant has been falsely implicated in the aforesaid offences. Merely because the applicant has criminal antecedents, the same by itself would not preclude this Court from examining whether a case for anticipatory bail is made out. A perusal of the allegations does not disclose any assault by the applicant by means of a dangerous weapon. It is submitted that there was only a verbal altercation between the applicant and the complainant and the remaining allegations are exaggerated only with a view to implicate the present applicant in one more offence and thereby create a criminal record. Though the applicant has criminal antecedents, he undertakes not to indulge in any offence in future and is ready to abide by any conditions that may be imposed by this Court. 5.
Considering the aforesaid submissions, I am inclined to protect the present applicant till the investigation papers are perused.
O R D E R

In the event of arrest of the applicant Baburao Alias Babrya Shankar Chavan, he shall be released on bail on furnishing a P.R. bond of Rs. 50,000/- (Rupees Fifty Thousand only) with one or two solvent sureties in the like amount each, in connection with FIR No. 0545 of 2025, registered with Degloor Police Station, District Nanded, for the offences punishable under Sections 132, 74, 121(1), 296, 351(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, on the following conditions :- 2/3
A) The applicant shall attend the concerned police station and report to the Investigating Officer on 24th, 25th, 26th, 30th and 31st January, 2026, and 1st, 6th, 7th and 8th February, 2026, between 12.00 noon and 02.00 p.m.
B) The Applicant shall also cooperate with the investigation.
C) The Applicant shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.

Needless to say, violation of any of the aforesaid conditions may entitle the prosecution to seek vacation of the interim relief granted herein above.
7.
The Investigating Officer shall make available the investigation papers on the next date of hearing.

Stand over to 10.02.2026.
