The learned counsel for the applicant submits that the applicant lady is falsely involved in the present crime. The applicant is a practicing Advocate and the main accused Meghraj Kadambande was operating the said Instagram I.D. which is alleged to have circulated the obscene photographs of the complainant and her friends. There was, therefore, mobile calls exchange between the applicant and the main accused Meghraj Kadambande, who was her client. The applicant was, therefore, issued a notice under Section 35 of the BNSS on 5.1.2026 and the applicant attended the police station and cooperated with the investigation. The learned trial court had protected the applicant by interim order during the pendency of the criminal Bail Application No. 42 of 2026 vide order dated 19.1.2026. The application for anticipatory bail was thereafter decided vide order dated 23.1.2026. Even thereafter, the police authorities have issued notice under Section 35 of the BNSS on 24.1.2026. The applicant is ready to abide by any conditions that may be
{2} ABA 171.26..odt imposed by this Court. The applicant is not having criminal antecedents. The applicant may therefore, be released on anticipatory bail. 5.
Thus, taking into consideration the aforesaid submissions, I am inclined to protect the applicant till the investigation papers are seen. However, on certain conditions. Hence the following order.
O R D E R
[I] In the event of arrest of the applicant in connection with Crime No. 6 of 2025, registered with Dhule Cyber Police Station, District Dhule, for the offences punishable under Sections 75 and 79 of the Bhartiya Nyaya Sanhita and under Section 67 of the Information Technology Act, the applicant Shivpriya Sitaram Patil be released on bail on furnishing PR Bond in the sum of Rs. 50,000/-, with one or more sureties in the like amount, on the following conditions :- [i] The applicant shall attend the concerned police station and report to the Investigating Officer on 5th, 6th, 12th and 13th February, 2026 between 11.00 a.m. to 1.00 p.m. and shall cooperate with the investigation.
[ii] The attendance of the applicant shall be treated as deemed custody for the purposes of Section 23 of the BNSS. [iii] The applicant shall not tamper with the prosecution evidence.
[iv] The Investigating Officer shall make investigation papers available on next date of hearing.
[iv] The applicant shall submit his Aadhar and Pan card to the Investigating Officer alongwith mobile numbers and addresses of two of his near relatives and his current addresses.
[v] Stand over to 25th February, 2026.
