Saraswati @ Sarubai Meghnath Shelke and Nagnath Narayan Shelke have filed the present application for their release on anticipatory bail in connection with Crime No. 469 of 2025, registered at Police Station, Kallam, Dist. Dharashiv for the offences punishable under Sections 75, 119-1, 118-2, 118-1, 189-2, 189-4, 191-2, 191-3, 190, 1152, 352, 35102 of the Bhartiya Nyaya Sanhita. 4.
The learned counsel for the applicant - Ms. Akshara Madke submits that the applicant Sarubai is the mother of applicant Ranjit and Abhijit Shelke. The applicants are deliberately roped in the present crime so as to implicate all the family members of the Shelke family. The son of the applicant-Sarubai i.e. Abhijit has registered an FIR bearing No. 467 of 2025 on 15.12.2025 at 19.46 p.m. against the complainant Uma and her family members, which is prior in point of time, whereas, the present FIR which is FIR No. 469 of 2025 is registered on 17.12.2026 at 19.48 hours. The applicants are the neighbours of the complainant and there are several disputes going on between the applicant and the
{2} complainant. Earlier also, there are FIRs and counter FIRs filed by them against each other. The other accused Abhijeet, son of applicant -Sarubai and accused Meghnath husband of Sarubai, were arrested and released after 15 days of custody. Nothing remains to be recovered at the instance of the present applicants. The applicants are ready to abide by the conditions that may be imposed by this Court. 4.
Thus, taking into consideration the aforesaid submissions and , particularly, the FIR No. 467 of 2025 registered at the behest of son of the applicant Sarubai, I am inclined to protect the applicants only on certain conditions till the investigation papers are seen. Hence, the following order :-
O R D E R
[I] In the event of arrest of the applicants, in connection with Crime No.469 of 2025 registered with Kallam Police Station, District Dharashiv for the offences punishable under Sections 75, 119-1, 118-2, 118-1, 189-2, 189-4, 191-2, 1913, 190, 115-2, 352, 351-2 of the Bhartiya Nyaya Sanhita, the applicants Saraswati @ Sarubai w/o. Meghnath Shelke and Nagnath s/o. Narayan Shelke be released on bail on furnishing PR Bond in the sum of Rs. 50,000/- each, with one or more sureties in the like amount, on the following conditions :- [i] The applicants shall attend the concerned police station and report to the Investigating Officer on 14th and 21st February, 2026 between 11.00 a.m. to 1.00 p.m. and shall cooperate with the investigation.
[ii] The applicants shall not enter the village Shelka Dhanora, Taluka Kallam, Dist. Dharashiv, till the time, the interim relief is operating, except with the permission of the Superintendent of Police, Dharashiv only in case of
{3} emergency.
[iii] The applicants shall not tamper with the prosecution evidence.
[iv] The Investigating Officer shall make investigation papers available on next date of hearing.
[iv] The applicants shall submit their Aadhar and Pan card to the Investigating Officer alongwith mobile numbers and addresses of two of their near relatives and their current address.
[v] Stand over to 9th March, 2026.
