Heard learned counsel for the applicant and the learned APP for the respondent-State.

Issue notice to the respondents, returnable on 09.03.2026. The learned APP waives notice on behalf of the respondent - State. 3.

The applicant has approached this Court apprehending arrest in connection with FIR No.188 of 2025, dated 19.12.2025, registered with Kondalwadi Police Station, District Nanded for the offences punishable under Sections 118(2), 118(1), 115(2), 352, 351(2), 351(3), 189(2), 191(2), 191(3), 190 and under Section 49 of BNS, 2023.

Learned counsel for the applicants submits that the applicants are falsely implicated in the present crime. It is submitted that a 1/3

counter FIR has been registered at the behest of Shaikh Khasim @ Harun Majid, who is accused No.2 in the present crime, against the complainant Shaikh Jafar Umar and other accused persons, being FIR No.189 of 2025, registered on 19.12.2025, arising out of the same incident dated 18.12.2025. It is further submitted that the other accused persons, namely Shaikh Khasim, Shaikh Fazil and Shaikh Naum, have already been arrested and released on regular bail vide order dated 24.12.2025, passed by the learned JMFC, Biloli. The iron rod is already recovered from Shaikh Khasim and nothing remains to be recovered at the instance of the present applicants. The applicants are attributed assault by means of stones and a wooden stick, which has not resulted in any grievous injury. The applicants are ready to cooperate with the investigation and to abide by any conditions that may be imposed by this Court.

Taking into consideration the aforesaid submission, I am inclined to protect the present applicant till the investigation papers are seen.

O R D E R

In the event of arrest of the applicants, namely (1) Shaikh Sultan Majid and (2) Shaikh Nasrat Majid, they shall be released on ad-interim bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousand) each with one or two solvent sureties in the like amount each, in connection with 2/3

FIR No.188 of 2025, registered with Kondalwadi Police Station, District Nanded, for the offences punishable under Sections 118(2), 118(1), 115(2), 352, 351(2), 351(3), 189(2), 191(2), 191(3), 190 and Section 49 of the Bharatiya Nyaya Sanhita, 2023, subject to the following conditions :- A) The Applicants are directed to attend the concerned police station and report to the Investigating Officer on 13th, 14th, 20th, 21st, 27th and 28th of February, 2026 between 12:00 noon and 02:00 p.m.

B) The Applicants shall also cooperate with the investigation.

C) The Applicants shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner.

Needless to say, violation of any of the aforesaid conditions may entitle the prosecution to seek cancellation of the interim relief granted herein above.

The Investigating Officer shall make available the investigation papers on the next date of hearing.
