The applicant has approached this Court seeking anticipatory bail in connection with Crime No.300 of 2025 registered with Adawad Police Station, Dist. Jalgaon, for the offences punishable under Sections 310-2 and 352 of the Bhartiya Nyaya Sanhita and under Sections 37(1), 37(3) and 135 of the Maharashtra Police Act. 2.
The case of the prosecution is that, on 11.12.2025, the informant alongwith 4 other companions was returning from Chopda in his car. Around 7.45 p.m. at Adwad Dhanora road, on the way to Jalgaon, the informant and his companions stopped to seeas to why huge crowd has gathered. On inquiry, they came to know that an individual was transporting cow meat and was thus intercepted at the spot. Thereafter, 7 to 8 accused arrived at the spot with knives and axe. They started verbally abusing and assaulting the informant and his companions with slaps and blows. It is further alleged that the accused
{2} persons also forcefully removed a 5 gram gold ring which the informant was wearing. Informant and his companions were assaulted with wooden log attached to the axe. Thereafter, the informant ran away towards Dhanora to save himself. The accused per sons fled away from the spot. Hence, the FIR came to be lodged.

The learned counsel for the applicant Smt. Tejaswini Raut, submits that the applicant is falsely involved in the present crime. There is another offence registered being Crime No. 299 of 2025 wherein, the main accused Shakurkhan Qureshi is already arrested for carrying prohibited meat. The applicant is alleged to have assaulted the complainant and other witnesses by means of wooden sticks. The applicant is not attributed any specific role. The injuries sustained by the complainant and other witnesses are simple in nature. The applicant is not having any criminal antecedents and is ready to abide by the conditions that may be imposed by this Court. The other co-accused have been released on this Court vide interim order dated 9.3.2026 passed in A.B.A. No. 356 of 2026. Thus, applying the principles of parity also, the applicant may be released on anticipatory bail. 4.
The learned APP on the other hand vehemently opposes the application on the ground that the complainant Yogesh has sustained grievous injuries. The other witnesses Chetan and Nikhil has also sustained blunt trauma which are shown to be simple in nature. The medical certificates of the complainant and witnesses corroborate the allegations made in the FIR. The applicant is involved in a serious offence of dacoity punishable under Section 310 of the Bhartiya Nyaya Sanhita. If the applicant is released on anticipatory bail, there is every likelihood that he may again commit similar crime. Hence, this is not fit case to grant anticipatory bail. Hence, the application may be rejected.

I have gone through the investigation papers made available by learned APP. Perusal of the investigation papers shows that complainant Yogesh has received grievous injuries, whereas, the other witnesses have received blunt trauma. The applicant is not named in the FIR. Neither there is any specific role attributed to the present applicant. The other co-accused have already been released on bail vide order dated 9.3.2026 passed in ABA No. 356 of 2026. The main accused Shakur Khan is already arrested and released on bail. The apprehension of the learned APP can be taken care of by imposing stringent conditions. Hence, I am inclined to exercise discretion under Section 482 of BNSS, however, on certain conditions. Hence, the following order :-
O R D E R
[I] In the event of arrest of the applicant, in connection with Crime No.300 of 2025 registered with Adawad Police Station, Dist. Jalgaon, for the offences punishable under Sections 310-2 and 352 of the Bhartiya Nyaya Sanhita and under Sections 37(1), 37(3) and 135 of the Maharashtra Police Act the applicant Altaf Khan Rahim Khan @ Altaf Rahim Qureshi, be released on bail on furnishing PR Bond in the sum of Rs. 50,000/-, with one or more sureties in the like amount, on the following conditions :- [i] The applicant shall attend the concerned police station and report to the Investigating Officer on 19th, 20th, 26th, 27th March and 2nd and 3rd April, 2026 between 11.00 a.m. to 1.00 p.m. and thereafter as and when called by the Investigating Officer till filing of charge sheet. [ii] The applicant shall not tamper with the prosecution evidence.
[iii] The applicant shall submit his Aadhar and Pan card
{4} to the Investigating Officer alongwith mobile numbers and addresses of two of his near relatives and his latest address. [iv] The applicant shall not threaten the complainant and other witnesses.
[v] The applicant shall not indulge in any identical offence.
[vi] A single violation of the conditions may entitle the prosecution to seek cancellation of bail.
[vii] The application stands disposed of.
