Heard learned Counsel for the Applicant and the learned APP for the Respondent/State.

Issue notice to the Respondents, returnable on 10.03.2026. Learned APP waives service of notice for Respondents/State. 3.
The Applicant has approached this Court apprehending arrest in connection with FIR No. 46 of 2026 dated 27.01.2026 registered with Bhagyanagar Police Station, District Nanded, for the offences punishable under Sections 316(2), 316(5), 318(4), 336(3) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 4.
Learned counsel for the applicant submits that the applicant had obtained a loan by following all prescribed norms from the
2 919(i).ABA-306-2026.doc MSRTC Cooperative Bank, Nanded, and that he is working with MSRTC at Nanded. It is submitted that the EMI instalments are being regularly deducted from his salary and that an amount of Rs. 18,008/- is being deducted from his salary account towards repayment. The allegation regarding sanctioning of loan beyond permissible limits is against the Director of the S.T. Cooperative Bank, Nanded, and not against the present applicant. It is further submitted that there is no default in repayment of installments on the part of the applicant. The Applicant has no criminal antecedents and is ready to abide by any conditions that may be imposed by this Court. 5.
Taking into consideration the aforesaid submissions, particularly that the amount of Rs. 18,008/- is being regularly deducted from the salary account of the applicant towards loan repayment, I am inclined to grant interim protection to the Applicant till the investigation papers are perused. Hence the following order :
ORDER
(a) In the event of arrest of the Applicant - Ankush Marotirao Yohan in connection with FIR No. 46 of 2026 dated 27.01.2026 registered with Bhagyanagar Police Station, District Nanded, for the offences punishable under Sections 316(2), 316(5), 318(4), 336(3) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, he be released on bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousands) with two solvent sureties in the like amount, on the following conditions :
3 919(i).ABA-306-2026.doc (b) The Applicant is directed to attend Bhagyanagar Police Station, District Nanded on 5th and 6th of March of 2026 between 12:00 noon and 02:00 p.m., and thereafter as and when called for by the Investigating Officer.
(c) The Applicant shall also cooperate with the investigation. (d) The Applicant shall not pressurize the prosecution witnesses and shall not tamper with the prosecution evidence, in any manner. 6.
Needless to say, violation of any of the aforesaid conditions may entitle the prosecution to seek vacation of the interim relief granted herein above.

The Investigating Officer shall make available the investigation papers on the next date of hearing. 8.
Stand over to 10.03.2026.
