The learned APP objects to the maintainability of the application filed directly before this Court, even on the ground of change in circumstances, as the earlier bail application has already been rejected.

The learned Counsel for the Applicants submits that the successive bail application is filed on the basis of a change in circumstances, namely the subsequent inquiry report submitted by the Divisional Deputy Registrar after the passing of the earlier order.

She further relies upon the interim order passed by this Court in the case of Pramod Narayan Londhe vs. State of Maharashtra and Anr., dated 25.02.2026 in ABA No. 75/2026, wherein protection was granted to other Directors who were also exonerated in the inquiry conducted under Section 88 of the Maharashtra Cooperative Societies Act. Even though the said application was a successive bail application and the earlier bail application of the Applicants therein was rejected. .
She, however, concedes that the present Applicants have directly approached this Court, and therefore prays that liberty may be granted to the Applicants to approach the Sessions Court. In the meantime, if interim protection is granted, the Applicants undertake to approach the Sessions Court immediately.

Taking into consideration the aforesaid submissions, permission is granted. The application is disposed of as withdrawn. However, bearing in mind that this Court has already protected other Directors, namely Pramod Narayan Londhe in ABA No. 75/2026 vide order dated 25.02.2026 and Bhausaheb Baban Nawale vs. State of Maharashtra and Anr. vide order dated 05.03.2026 passed in ABA No. 362/2026, no coercive steps shall be taken against the Applicants for a period of ten days so as to enable the Applicants to approach the learned Sessions Court seeking anticipatory bail.

It is made clear that this protection shall expire after a period of ten days.
