The applicant has approached this court seeking grant of anticipatory bail in connection with Crime No. 0126 of 2026 registered with Sangamner City Police Station, District. Ahilyanagar, for the offences punishable U/Sec. 115-2, 119-1, 324-4, 351-2 and 352 of the Bharatiya Nyaya Sanhita.

The case of the prosecution is that on 05/02/2026 the informant was questioning the Talathi as well as Gramsevak for their sudden action of construction of a road across the informant's landed property. The applicant intervened and instigated the JCB driver to run over the informant under the JCB. Thereafter the applicant beat the informant with fist and kicks and snatched his mobile phone. He damaged the phone by banging it against the JCB. The applicant then snatched the gold chain worn by the informant and the applicant allegedly caused hurt to the informant. The applicant also caused damage to his mobile phone while robbing him of his gold chain. As such, the offence was registered.

Mr. Kute, the learned counsel for the applicant submits that
{2} the applicant is falsely implicated in the present crime. The villagers had made a complaint to the Revenue Officers for removal of encroachment done by the complainant and some other villagers. The revenue officers had acted upon such complaint for removal of encroachment. Enraged thereby, the complainant has deliberately roped the applicant in the present application. Lateron, the matter about encroachment is amicably resolved by the Grievance Redressal Committee of the village, wherein, the applicant has already paid an amount of Rs. 20,000/- for the damage to the mobile phone of the complainant. The applicant is not having any criminal antecedents and is ready to abide by any conditions that may be imposed by this Court. Hence, the applicant may be protected.

As against this, the learned APP vehemently opposes the application on the ground that the offence is serious. There are eye witnesses to the incident. The mobile phone found on the spot was damaged due to assault of the applicant. The applicant and the complainant are the residents of the same village. The applicant, if released on bail, may again commit a similar offence and thereby disturb the law and order. Hence, the application may be rejected. 5.
I have gone through the investigation papers made available by the learned APP. The investigation in the present crime is almost complete. The statements of the witnesses are recorded. The record also shows that the complaint is made by the villagers to the revenue Officer to remove the alleged encroachment made by the complainant. The false implication of the applicant at this stage cannot be ruled out. However, these are prima facie observations and are made only for the purpose of deciding the present application.

Be that as it may, since the mater is amicably resolve with
{3} the intervention of the Grievance Redressal Committee of the village, I am inclined to protect the applicant, however, on certain conditions. Hence, the following order :-
O R D E R
[I] In the event of arrest of the applicant, in connection with Crime No.0126 of 2026 registered with Sangamner City Police Station, District. Ahilyanagar, for the offences punishable U/Sec. 115-2, 119-1, 324-4, 351-2 and 352 of the Bharatiya Nyaya Sanhita, the applicant Sachin Maruti Raut, be released on bail on furnishing PR Bond in the sum of Rs. 50,000/-, with one or more sureties in the like amount, on the following conditions :- [i] The applicant shall attend the concerned police station and report to the Investigating Officer on 5th 6th, 11th and 12th May, 2026 and thereafter, as and when called by the investigating officer between 11.00 p.m. to 2.00 p.m. and shall cooperate with the investigation.
[ii] The applicant shall not enter the village Ghulewadi in the jurisdiction of Police Station, Sangamner city, till filing of the charge sheet.
[iii] A single violation of the condition shall entitle the prosecution to seek cancellation of bail and shall result in vacation of interim relief.
[iv] The applicant shall not tamper with the prosecution evidence.
[v] The applicant shall submit his Aadhar and Pan card to the Investigating Officer alongwith mobile numbers and addresses of two of his near relatives and his current address.
[v] The application stands disposed of.
