The applicant has approached this Court seeking anticipatory bail in connection with Crime No. 130 of 2026 registered with MIDC Police Station, Ahilyanagar for the offences punishable under Sections 109-1, 115-2, 351-2, 352 r/w. 3-5 of the Bhartiya Nyaya Sanhita. 2.
Mr. Chormal, the learned counsel for the applicant submits that the applicants is falsely implicated in the present crime. The present FIR No. 130 of 2026 is a fallout of Crime No. 129 of 2026 registered by Gorakh Jadhav against the complainant Chandrakant, Dattratray and Bharat and Rushi Kale, registered on 19.2.2026, which is prior in point of time. All the accused persons in the aforesaid crime No. 129 of 2026 are also released on bail. In so far as the other accused persons named in the FIR No. 130 of 2026 alongwith the applicants, are released on regular bail. The applicant is alleged to have assaulted by means of an iron rod. Even if the said allegations are taken to be true, the injury
{2} caused to the complainant's father is simple in nature and other accused are also alleged to have assaulted the father of the complainant. The allegations are general in nature. The applicant is not having any criminal antecedents and is ready to abide by any conditions that may be imposed by this Court. Hence, the applicant may be protected. 3.
As against this, the learned APP and Mr. Narwade, the learned counsel assisting the prosecution vehemently oppose the application on the ground that the applicant is involved in a serious offence of causing voluntarily grievous hurt by means of dangerous weapons and attempt to commit murder. The applicant is alleged with the offence of committing murder which is punishable with life imprisonment. There are allegations of applicant Balasaheb assaulting the father of the complainant. There are injury certificates which corroborates the allegations. The statements of the injured witnesses also narrates the incident, wherein, the applicant is alleged to have assaulted the father of the complainant i.e Dattatray Kale by means of iron rod. The applicant and complainant are neighbours. There is every likelihood that the applicant, if released, may again indulge into an identical offence or may threaten the complainant, which may prejudice the prosecution case. Hence, the application may be rejected. 4.
I have gone through the investigation papers made available by the learned APP. The perusal of injury certificate of father of complainant i.e. Dattatray shows simple injuries sustained by him i.e. contused lacerated wound on occipital region. Grievous injury is sustained by Hrishikesh, however, the applicant is alleged to have assaulted Dattatray. There are counter FIRs registered bearing FIR No. 129 of 2026 at the behest of Gorakh against the complainant Chandrakant. The false implication of the applicant cannot be ruled out at this stage. However, these observations are prima facie in nature and
{3} are made only for the purpose of deciding the application. Taking into consideration that all other accused persons are already arrested and the necessary recoveries are made, since the applicant does not have any criminal antecedents, I am inclined to protect the applicant. The apprehensions of the learned APP and assisting counsel can be taken care of by imposing stringent conditions. Hence, the following order :-
O R D E R
[I] In the event of arrest of the applicant, in connection with Crime No.130 of 2026 registered with MIDC Police Station, Ahilyanagar for the offences punishable under Sections 109-1, 115-2, 351-2, 352 r/w. 3-5 of the Bhartiya Nyaya Sanhita. the applicant Balasaheb Bhausaheb Jadhav be released on bail on furnishing PR Bond in the sum of Rs. 50,000/- , with one or more sureties in the like amount, on the following conditions :- [i] The applicant shall attend the concerned police station and report to the Investigating Officer on every Monday and Tuesday i.e. on 27th, 28th April, 2026, 4th and 5th May, 2026 and 11th and 12th May, 2026 between 2.00 p.m. to 5. 00 p.m. and thereafter as and when called by the Investigating Officer and shall cooperate with the investigation. [ii] The applicant shall not tamper with the prosecution evidence.
[iii] The applicant shall not enter the jurisdiction of village Shingave Naik, Taluka and District Ahilylanagar till filing of charge sheet.
[iv] A single violation of the conditions shall entitle the prosecution to seek cancellation of bail.
[v] The applicant shall submit his Aadhar card and Pan card to the Investigating Officer alongwith mobile numbers
{4} and addresses of two of his near relatives and his present address.
[vi] The application stands disposed of. The application for permission to assist the prosecution also stands disposed of.
