The learned APP seeks time as the investigation papers are not received.

The learned Counsel for the Applicants submits that the Applicants are falsely implicated in the present crime merely on the basis of suspicion. The FIR was lodged after a delay of 51 days, and only after much deliberation were the Applicants implicated. The Applicants and the Complainant are related to each other, and there are ongoing civil disputes between them before the Civil Judge, Senior Division, Shrirampur, being RCS No. 90/2018 and RCS No. 202/2024. The Applicants are thus deliberately implicated in the present crime with the intention of wreaking vengeance against their family members. Applicant No. 1 is suffering from heart disease,

2 917.ABA-645-2026.doc whereas Applicant No. 2 is an agricultural farmer. The Applicants are not having any criminal antecedents and are ready to abide by any conditions that may be imposed by this Court. Hence the Applicants may be protected.

Thus, taking into consideration the aforesaid submissions, I am inclined to protect the Applicants until the investigation papers are received, subject, however, to certain conditions. Hence the following order :

ORDER

(a) In the event of arrest of the Applicants - Sudhir Madhukar Bansode and Prathmesh Sudhir Bansode in connection with Crime No. 348/2025 registered with Shrirampur City Police Station, District Ahilyanagar for the offences punishable under Sections 305(A), 331(1), (2) of the Bhartiya Nyaya Sanhita, 2023, they be released on bail on furnishing P.R. bond of Rs.50,000/- (Rupees Fifty Thousands) each with two solvent sureties in the like amount, on the following conditions :

(b) The Applicants are directed to attend Shrirampur City Police Station, District Ahilyanagar on every Saturday between 11:00 am. to 01:00 pm. and co-operate with the Investigating Officer, until further orders.

(c) The Applicants shall not tamper with the evidence and shall appear before the Investigating Officer as and when required, apart from the days already mentioned above.
