- 1 - acb4.26.odt
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD 957 APPLICATION FOR CANCELLATION OF BAIL NO. 4 OF 2026 IN BA/73/2025 Shivkanta Balaji Bandgar ....Applicant
VERSUS
The State of Maharashtra & others .....Respondents Mr. S. N. Zakade, Advocate for Applicant.
Mrs. P. V. Diggikar, APP for the State.
CORAM : SACHIN S. DESHMUKH, J.
DATE : 23rd JANUARY, 2026.
PER COURT :
1.
Applicant has filed this application under Section 483 of BNSS, for cancellation of bail granted to Gopal s/o Digambar Khandekar and Pornima w/o Gopal Khandekar, by quashing and setting aside order dated 24.02.2025 passed by this Court in Bail Application No. 73/2025.
2.
Learned counsel for the Applicant submits that by order dated 24.02.2025 the accused were granted bail by this Court by imposing conditions. It is further contended that, now, they are not assisting the investigation. Hence, prayed to allow the application by cancelling bail.
- 2 - acb4.26.odt 3.
Learned APP submitted that the investigation in the crime is complete and charge-sheet is already presented. 4.
In view of the fact that the investigation in the crime is complete, fallacy in the submissions is rather surfacing from the fact of presenting charge-sheet. As such, submission of learned Counsel for Applicant does not warrant any consideration. At this stage, filing of application is nothing sort of abuse of process of law. Hence, application stands dismissed with cost of Rs. 1,000/- to be paid to High Court Legal Services, Sub-Committee at Aurangabad. (SACHIN S. DESHMUKH, J.) dyb
