By order dated 12.01.2026, this Court observed that the learned appointed counsel was absent. Consequently, the High Court Legal Services SubCommittee, Nagpur was directed to remove the name of the said counsel from the legal aid panel and to appoint another counsel to represent the appellant. 2.

Pursuant to the said order dated 12.01.2026, Mr. Rahul Hajare was appointed by the High Court Legal Services Sub-Committee, Nagpur to represent the appellant.

Learned counsel who was earlier appointed through the High Court Legal Services Sub-Committee, Nagpur has filed application for recalling of the order dated 12.01.2026.

Learned counsel submits that she was appointed to represent the appellant on 02.12.2025. It is further submitted that when the matter was listed on 12.01.2026, her name did not reflect in the cause list and, therefore, her absence on the said date was neither deliberate nor intentional. She has also tendered an unconditional apology.

Learned Additional Public Prosecutor has no objection if the application is allowed.

In view of the aforesaid submissions, the order dated 12.01.2026 stands recalled. Learned appointed counsel is directed to make every endeavour to represent the appellant on each and every date hereafter without fail. 7.

Consequently, the newly appointed counsel stands discharged. 8.

The criminal application stands disposed of accordingly. Criminal Appeal No. 17 of 2023 List the matter for further consideration in the week commencing from 9th February, 2026.
