CRIMINAL APPLICATION [APPA] NO. 111 OF 2026:

This is an application for suspension of sentence.

Issue notice to non-applicant/ respondent, returnable forthwith. Learned A.P.P. waives service of notice on behalf of non-applicant/State.

The applicant was convicted for the offences punishable under Sections 353, 332, 504 and 427 of the Indian Penal Code, 1860, (IPC). However, in view of Section 71 of the IPC, the accused was sentenced only for the offence punishable under Section 332 of the IPC and he was ordered to undergo rigorous imprisonment for three months and to pay fine of Rs.4,000/- (Rupees Four Thousand), in default, to suffer rigorous imprisonment for 15 (fifteen) days.

Considering the fact that the applicant is sentenced to rigorous imprisonment for three months, which is a short-term sentence, and the fact that the applicant has already deposited fine amount, I am inclined to suspend the sentence. In this view of the matter, following order is passed:

ORDER

(i) The Criminal Application is allowed and disposed of;

(ii) The substantive sentence passed by the trial Court in Sessions Case No.117/2022 by the Additional Sessions Judge, Achalpur, dated 14/01/2026, is hereby suspended;

(iii) The applicant/accused (Lalita Dadarao Dahilekar) be released on bail on her

furnishing a P.R. bond of Rs.25,000/- (Twenty Five Thousand Rupees) with one solvent sureties in the like amount;

(iv) The applicant shall remain present as and when called by this Court;
