This is an application for suspension of sentence. The appellant/applicant came to be convicted by judgment and order of conviction dated 06.02.2026 passed by the Additional Sessions Judge, Achalpur in
Sessions Case No.63/2019, by which the appellant/ applicant came to be convicted for offence punishable under Section 353 of the Indian Penal Code and is sentenced to undergo rigorous imprisonment for 3 months and to pay fine of Rs.2000/-. In default of payment of fine, he is ordered to suffer rigorous imprisonment for 15 days.

The learned Counsel for the appellant/ applicant submits that the sentence is short term sentence and the appellant has good case on merits. 4.
Considering the fact that the sentence imposed is a short term sentence, and further an arguable case is made out by the appellant/applicant, I am inclined to suspend the sentence, hence, the following order.
ORDER.
(a) Criminal Application is allowed and disposed of.
(b) The impugned sentence imposed by judgment and order dated 06.02.2026 passed by the Additional Sessions Judge, Achalpur in Sessions Case No.63/2019, is hereby suspended, and applicant/appellant be released on bail on furnishing P.R.
Bond in the sum of Rs.25,000/- with two
sureties in the like amount.
[c] The applicant /appellant to file an undertaking that he will appear before this Court as and when called.
