By the present application, the applicant - accused / jail inmate seeking condonation of delay of 437 days caused while lodging the appeal under Section 14-A of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 to challenge the order dated 10/10/2024 passed by the learned Additional Sessions Judge, Aheri, Dist. Gadchiroli in Special (POCSO) Case No.125/2023.

Learned APP as well as learned counsel appearing for the non-applicant No.2 strongly opposed the application.

Needless to say that, the appellant came to be arrested on 12/06/2023 in connection with Crime No.197/2023 registered with Aheri Police Station for the offences punishable under Sections 376, 376(2)(n), 376(3), 376-D, 376-DA and 377 r/w Section 34 of the IPC and Sections 4, 6, 8 and 12 of the Protection of Children from Sexual Offences Act (POCSO) Act, 2012 and Sections 3(1)(w)(i)(ii), 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and since then, he is behind the bar, therefore, considering the grounds set out in the application, the delay of 437 days caused while lodging the appeal is hereby condoned. 5.

The criminal application is disposed of.
