PANSARE & NIVEDITA P. MEHTA, JJ. DATED : 25 th MARCH, 2026 The applicants have filed the present application seeking condonation of delay of 57 days in filing the accompanying appeal. The appeal challenges the judgment and order dated 23.05.2025 passed by the learned Additional Sessions Judge-5, Nagpur, in Sessions Case No. 433/2018, whereby the applicants stand convicted under Sections 120-B, 364 read with 34 and Sections 120-B, 302 read with 34 of the Indian Penal Code, 1860 (for short, "IPC"). The applicants are sentenced to undergo rigorous imprisonment for six years for offence under Section 120-B, 364 read with 34 of the IPC and imprisonment for life for offence under Section 120-B, 302 r/w. 34 of the IPC.

It is submitted that, owing to the lack of legal and financial assistance, the applicants were unable to make necessary arrangements to engage a counsel to represent them before this Court. Subsequently, the applicants approached the High Court Legal Services Sub-Committee, Nagpur, seeking legal aid for representation. Pursuant thereto, the learned counsel appointed for the applicants has filed the present application along with the appeal.

In view of the aforesaid circumstances, the application deserves to be allowed and is accordingly allowed. The delay of 57 days in filing the appeal is hereby condoned. The appeal be registered accordingly. Criminal Appeal (Stamp) No. 2201/2026.
