By this application, the applicant is seeking condonation of delay of 1044 days, which is caused in preferring the appeal against the conviction. The appellant / applicant was prosecuted for the offence punishable under Section 307 of the Indian Penal code in Sessions Case No. 08/2019, wherein he was convicted. Thereafter, he sent request letter to the High Court Legal Services Sub-Committee to appoint somebody to file the appeal against the said conviction. Accordingly, High Court Legal Services Sub-Committee appointed Shri D.A. Sonawane, learned counsel to file appeal vide letter dated 09.05.2023. He did not take any efforts to file the appeal and subsequently, the applicant came to know that no appeal was filed, therefore, delay of 1044 days is caused in preferring the appeal.

Considering the reasons mentioned in the application, the same needs to be allowed. Accordingly, application for condonation of delay is allowed. Delay of

Appeal be registered.

After registration of appeal, it be listed before this Court for further consideration.
