26.03.2026 By this application applicant is seeking condonation of delay which is caused in preferring revision challenging the rejection of the discharge application filed by the applicant below exh.171.

Heard learned counsel for the applicant who submitted that the applicant is of advanceD age and senior citizen. At the time of rejection of Exh.171 he was advised that all the similarly placed applications can be challenged before this Court together at the same time and therefore, he also filed revision challenging the discharge application. It is further contended that the applicant being of an advance age
suffering from various ailments, Particularly regarding his vision due to which it was not possible for him to travel alone and therefore, the delay is caused. In view of that it submitted that reasons mentioned in the application is reasonable and justifiable. If delay is not condoned he will deprive from his rights. In view of that delay be condoned. 3.
Per contra learned APP strongly opposed the application and submitted that delay is of 485 days and it is not properly explained. Therefore, application deserves to be rejected.

After hearing both the sides and on perusal of the application it reveals that the applicant is aged about 82 years therefore, the contention raised in the application that he is advance in age and suffering from various ailments. The other similarly situated revision applications are pending before this Court. The reason mentioned in the application also appears to be just and reasonable ground. Considering the advanced age of the applicant though the reasons is not mentioned in the application but it is explained by way of affidavit and which is filed on record.

It is well settled that while considering the delay application liberal approach is to be taken and not pedantic approach as the valuable rights of the parties are involved. 6.
The parties are to be permitted to litigate their cause on its own merits instead of rejecting the prayer on technical reasons.

Considering all these aspects the application deserves to be allowed.

Accordingly I proceed to pass the following order:- (i) Application is allowed.
(ii) Delay of 485 days is condoned subject to the cost of Rs.3000/-.
(iii) Costs be deposited in the 'Public Welfare Account' bearing No.129712010001014, IFSC Code UBIN0812978, Union Bank of India, Branch High Court, Civil Lines, Nagpur within one week.
Revision be number. Revision Appl. No............/2026 On registration of the revision learned APP waives notice for the State and seeks time to file reply. Applicant is permitted to file copy of charge-sheet in physical form.
Present revision application along with connected applications be listed on 23.04.2026.
