By this Application, the Applicant is seeking suspension of sentence and releasing him on bail. 2.
The Applicant has challenged the judgment and order passed by the Judicial Magistrate First Class, Ner, District Yavatmal in S.C.C. No. 273/2011 and confirmed in Criminal Appeal No.20/2017 by which the Applicant is convicted for the offence punishable under Section 354 of the Indian Penal Code and sentenced to suffer simple imprisonment for one year and to pay fine of Rs. 500/- and in default to suffer simple imprisonment for 15 days. 3.
Heard learned Counsel for the Applicant who submitted that the Revision would take its own time for its final disposal. He has also pointed out from the impugned judgment that he has many arguable points in the present
2 48.APPR.23-2026.odt Revision, however the Revision would take its own time for its final disposal. Moreover, the punishment is less than three years.

In view of that, the Application for suspension of sentence deserves to be allowed. Accordingly, I proceed to pass the following order:-
O R D E R
i.
Criminal Application (APPR) No. 23/2026, is hereby allowed.
ii.
The execution of the sentence passed in S.C.C. No. 273/2011 and confirmed in Criminal Appeal No.20/2017, is hereby suspended till the disposal of the Revision.
iii.
The Applicant - Sharik Husain Imdad Husain, shall be released on bail on executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.

Learned APP waives notice for the Non-applicant/ State.
