By these applications, the applicant is seeking suspension of sentence and releasing him on bail.

The applicant was prosecuted for the offence punishable under Section 138 of the Negotiable Instruments Act and after recording evidence, he was sentenced to suffer simple imprisonment for six months and to pay the compensation of Rs.5,83,004/- to the complainant and in default of payment of compensation, he will have to undergo simple imprisonment for a period of two months. The said judgment of conviction is confirmed in Criminal Appeal No.35/2023 by order dated 17.10.2025, hence these applications.

Leaned counsel for the applicant, who submitted that the revision application would take its own time for its final disposal. He also taken me through the impugned judgment and submitted that he has many arguable points in the present revision application, but it would take its own time. In the meantime, if the sentence is executed the revision application would become infructuous. He view of that, he prays for suspension of sentence and releasing the applicant on bail.

After considering the impugned judgment, admittedly, the revision would take its own time for its final disposal, hence both applications deserve to be allowed.

The execution of the sentence is suspended till disposal of the criminal revision application.

The applicant shall be released on bail on executing PR bond of Rs.15,000/- with one solvent surety of the like amount.

The applications are disposed of.

Call for record and proceedings.

Revision application be listed before this Court for final disposal after record and proceeding is received.
