DATE : 07.03.2026 By this application the applicant is seeking suspension of sentence and releasing him on bail. 2.

Heard learned counsel for the applicant who submitted that the present applicant is convicted by the Judicial Magistrate First Class Court No.2, Achalpur in SCC No.376/2011 by sentencing him to suffer simple imprisonment for six months and compensation of Rs.1 lakh to the complainant.

Being aggrieved with the same applicant preferred Criminal Appeal No.30/2018 but same came to be dismissed and the judgment and order of sentence passed by the Judicial Magistrate First Class, Court No.2, Achalpur is confirmed.

Being aggrieved with the same the present revision application is preferred by the applicant. Learned counsel

for the applicant has pointed out that in both judgments she has many arguable points. But it will take its own time for its final disposal. She has already deposited 20% amount during the pendency of the appeal. Now revision will take its own time for final disposal. In the meantime, if sentence is executed then this revision would become infructuous. In view of that, she prayed for suspension of sentence and grant of bail to the applicant. 5.

Issue notice to the non-applicant.

Perused the impugned judgment from which she has pointed out that she has many arguable points. Revision would take its own time for its final disposal. In the meantime if sentence is executed, then revision would become infructuous.

In view of that, the order of sentence passed by the Judicial Magistrate First Class Court No.2, Achalpur in SCC No.376/2011 and confirmed in Criminal Appeal No.30/2018 the execution of the same is hereby suspended till disposal of the revision application. The applicant is released on bail on executing P.R. bond of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount.

The APPR No.41/2026 stands disposed of.
