The applicant has taken out this application seeking relaxation of condition [e] of the order dated 24.04.2025, which reads as under : "[e] The applicant shall not enter into the vicinity of Saigaon, Tahsil Bhiwapur, District Nagpur till culmination of the trial."

The learned Counsel for the applicant submits that the family of applicant is residing at
Saigaon and he is running a small hotel in the said vicinity. He submits that he is earning bread and butter for the entire family, including himself from the earning from said hotel, therefore, seeks permission to enter into the village Saigaon by relaxing condition [e] of the order dated 24.04.2025.

On the other hand, the learned A.P.P.
submits that when bail was granted, the applicant had not objected to the said condition. The trial has commenced, however, till date no witness is examined, and material witnesses are residing in the said vicinity, however, if said condition is relaxed, there is every possibility of tampering with the witnesses. He therefore, prays for dismissal of the application.

Admittedly condition [e] of the bail order dated 24.04.2025 restrains the applicant from entering into the vicinity of Saigaon village. When this order was passed, the applicant has readily
accepted the said condition, and now is coming for relaxation. At this juncture, it would be necessary to mention here that till today the material witness are not examined and therefore, said condition cannot be relaxed. In this view of the matter, the present application is rejected. However, the applicant is at liberty to file fresh application for relaxation of the said condition, after examination of the material witness.

Fees of the appointed Counsel be quantified and paid as per Rules.
