The applicant states that considering the prima facie case in the matter, the interim order passed by this Court 29.08.2022. According to the applicant, no offence is made out against him in view of the allegations raised in the First Information Report and, consequently, the chargesheet which is now sought to be filed on record would not be material in the matter.

Learned APP states that if the charge-sheet is on record, the factual position would be clear in the matter. 3.

Hence, for the reasons stated in the application, the application is allowed.

The prosecution is permitted to file charge-sheet within 10 days.

Immediately after the receipt of the charge-sheet, the appellant is granted leave to make necessary amendment in the application within one week thereafter. 5.
