Ms. S. Haider APP for non-applicant/State.

CORAM: M. M. NERLIKAR, J .

DATED : 27/04/2026.

Heard.

2.

The applicant had been granted bail by an order dated 25/07/2022 passed in Criminal Bail Application (BA) No. 1170/2021, wherein condition No. "c" was imposed which is reproduced as under:- "c"

The applicant shall attend the concerned Police Station on every 1st and 16th day of each month between 10.00 a.m. to 12.00 noon, till the culmination of trial."

Thereafter, it appears from the record that the applicant has preferred Criminal Application No. 1362/2023 for relaxation of the above condition, and accordingly, by order dated 18/12/2023, this Court has relaxed the

2 15 APP 1178.26 condition. However, the said application was allowed partly with the direction that the applicant shall attend the concerned police station on every first day of each month between 10.00 am to 12 noon till the culmination of trial. Therefore, the applicant has filed the present application for relaxation of condition No. "3" of order dated 18/12/2023.

3.

I have heard the learned counsel for the applicant and the learned APP. It appears from the submissions made by both parties that the trial is at the midst. The applicant is attending the trial regularly. Considering this fact, I am inclined to relax condition No.3. However, the same is subject to the following condition:- The applicant shall attend the Trial Court on each and every date. In case of default, even for one date, the condition relaxed by this Court by today's order would be treated as cancelled.

4.

With the above observations, the application is partly allowed and disposed of.
