By this application, the applicant is seeking relaxation of condition no.[b] incorporated in order dated 11.03.2026 passed by this Court while granting bail to the applicant, which reads as under :
"(b) The applicant Rajpal Sajjansingh Malviya in connection with Crime No.6 of 2025 registered with Khaperkheda Police Station, Nagpur Rural be released on bail on furnishing P.R. bond of Rs.50,000/- with one local surety and surety of a resident of Sonkutch, District Dewas, State of
Madhya Pradesh, in the like amount."

The learned Counsel for the applicant submits that the applicant is seeking partial relaxation of condition to the extent of furnishing surety of resident of Sonkutch, District Dewas, (MP). He submits that though the order is passed on 11.03.2026, however considering the condition laid down in Clause [b] of the said order and since the applicant was not able to comply with the same, he is still in jail. He submits that the applicant be granted an opportunity by partially relaxing the condition of furnishing surety of resident of Sonkutch, District Dewas (MP). It is further submitted that after release, the applicant will arrange and furnish surety who is resident of Sonkutch, District Dewas, within a period of two weeks of his release.

Prayer made by the applicant seems to be reasonable. It appears from the record that though this Court has ordered release of the applicant on bail by imposing certain conditions, however, in view of noncompliance of condition no.[b], the applicant was not released. The said condition is therefore, relaxed by the
following order.
ORDER
(a) The applicant Rajpal Sajjansingh Malviya be released on regular bail in connection with Crime No.6 of 2025 registered with Khaperkheda Police Station, Nagpur Rural for the offence punishable under Sections 103[1], 238 and 3[5] of the Bharatiya Nyaya Sanhita, 2023 on furnishing P.R. bond of Rs.50,000/- with one local surety. After his release, the applicant to furnish a surety in the said amount, who is resident of Sonkutch, District Dewas (MP), within a period of two weeks of his release.
(b) In case the applicant fails to furnish the surety who is resident of Sonkutch, District Dewas (MP), within the above stipulated period, the bail granted to him vide order dated 11.03.2026 should be treated as cancelled.
(c) Criminal Application is disposed of accordingly, by modifying condition [b] to the above extent.
