and Registrar's Orders.
Mr. Disha C. Kamwani, Advocate for the Applicant. Mr. H.R. Dhumale, A.P.P. for the Non-applicant/State. CORAM :

DATE :

Heard.
2.
The application is filed for relaxation of Condition No.(iii) of the order dated 22/10/2024, by which, this Court, while granting bail to the applicant has put in condition, which reads thus:- "(iii) The applicant shall attend the Economic Offence Wing, Nagpur Rural twice in a month i.e. 1st and 15th day of every month between 10.00 AM and 1.00 PM and the Investigating Officer shall record her presence."
3.
The learned counsel for the applicant submits that, the applicant has abided by the said condition till today. He further submits that, since the order was passed on 22/10/2024 no purpose would
be served by keeping the said condition as it is, and therefore, same be relaxed in the interest of justice. 4.
On the other hand, the learned A.P.P.
confirms this fact that the applicant has complied condition No.(iii). However, he further submits that, considering the magnitude of the offence, the presence of the applicant would be required by the Investigating Officer, and therefore, he submits that, condition be imposed that the applicant shall remain present as and when required by the Investigating Officer and the same would serve the purpose. 5.
Upon consideration of the rival submissions, it appears from the record that, the order wherein the condition No.(iii) was imposed was passed on 22/10/2024. Since almost one and half year the applicant is attending the Police Station as was directed in the condition No.(iii). Since there is compliance of condition No.(iii) for more than one and half year, I am inclined to relax the said condition. Therefore, instead of attending the Economic Offence Wing, Nagpur Rural twice in a month i.e. 1st and 15th day of every month between 10.00 AM and 1.00 PM, the applicant shall attend the Economic Offence Wing, Nagpur Rural as and when called by the Investigating Officer. Hence, the condition No.(iii) is modified in the above terms. The
Criminal Application [APPP] No.1622/2026 is disposed of accordingly.
