This is an application seeking relaxation of condition imposed by this Court by order dated 01.07.2017 while granting bail to the applicant. The said condition restricts the applicant from entering Chandur Bazar town till the prosecution is concluded.

The learned Counsel appearing for the applicant submits that marriage of applicant is scheduled on 19.06.2026. He is permanent resident of Chandur Bazar, however, presently he is working at Agra. There are certain
functions/ceremonies which are to be performed at Chandur Bazar, though the venue of marriage is at Amravati. She therefore submits that since 2017 the applicant has complied with the aforesaid condition, and therefore, considering the difficulty, the same needs to be relaxed.

On the other hand, the learned A.P.P. submits that the trial is pending since 2017 and till date even charge is not framed due to non-cooperation of the applicant. She therefore, submits that if the applicant assures this Court that he will remain present before the trial Court for framing charge, in that contingency only the said condition may be relaxed. 5.
I have heard the submissions of both the sides. This Court has called for the status report from the District Judge and Additional Sessions Judge, Achalpur, which is received, wherein it is specifically stated that the accused is continuously absent. It appears that the trial is pending since 2017. It is an unfortunate part that since 2017, charge is not frame, due to non-cooperation on the part of the applicant. In such circumstances, I am of the considered opinion that the applicant shall remain present before the concerned Court on 15.06.2026 and the said Court shall try to take appropriate steps for framing of charge. Only on this condition, the applicant is permitted to enter Chandur Bazar. Accordingly,
the condition imposed by this Court in that respect vide order dated 01.07.2017 is hereby relaxed.

Criminal Application is accordingly allowed and disposed of.
