By the present Application, the Applicant had sought the following substantive reliefs :- "a.

Quash and set aside the proclamation order dated 13th November, 2019 passed under Section 82 CrPC in CC No. 1134/PW/2014;

b.

Recall and quash the Non-Bailable Warrant, issued pursuant thereto;

c.

Permit the Applicant to appear before the Trial Court and apply for bail, without being prejudiced by the impugned proclamation;"

After the matter was heard for substantial time and upon this Court having expressed its view of not being inclined to entertain the present Application, moreso in view of the order dated 16th January, 2020 passed by the Court of Judicial Magistrate, First Class, 46th Court, Shivdi, in Police Case No. PW/4601134 of 2014, Mr. Aditya Parmar, learned Advocate for the Applicant, on specific instructions from the Applicant, seeks leave to withdraw the present Application. Mr. Aditya Parmar states that the Applicant would surrender before the Court of Judicial Magistrate, First Class, 46th Court, Shivdi, in Police Case No. PW/4601134 of 2014 within two weeks from today and thereafter file an appropriate Application before the Court of Judicial Magistrate, First Class, seeking cancellation of the proclamation. Mr. Tanveer Khan does not object to the request made by Mr. Aditya Parmar.

In view of the above, leave to withdraw the present Application is granted. If any Application is filed by the Applicant before the Court of Judicial Magistrate, First Class, Shivdi the same be considered on its own merits and in strictly accordance with

law.

On the request of Mr. Aditya Parmar made on instructions from the Applicant, two weeks time is granted to the Applicant to surrender before the Court of Judicial Magistrate, First Class, Shivdi.

Criminal Application No. 13 of 2026 is dismissed as withdrawn.
